AMADOR COUNTY AIR POLLUTION CONTROL DISTRICT
RULE 710 - NOTICE OF PUBLIC HEARING
A. For hearings requested under Rule 519, the clerk of the Hearing Board shall serve notice to the time
and place of a hearing on the Air Pollution Control Officer and upon the applicant or permittee affected, not less
than ten (10) days prior to such hearing. In addition, such notice shall be published in at least one newspaper
of general circulation within the District. The notice shall state the time and place of the hearing and such other
information as may be necessary to reasonably apprise the people within the District of the nature and purpose
of the hearing.
B. Except as stated in (A), (C), (D), and (E), in the case of a hearing to consider the application for a variance,
the clerk of the Hearing Board shall serve a notice of the time and place of a hearing upon the Air Pollution Control
Officer, all other districts within the air basin, the Air Resources Board, the Environmental Protection Agency,
the applicant or permittee, and every person who requests such a notice not less than 30 days prior to such hearing.
In addition, such notice shall be published in at least one daily newspaper of general circulation in the District
at least thirty (30) days prior to the hearing. The notice shall state the time and place of the hearing, and the
place where the application, including any proposed conditions or increments of progress, is available for public
inspection, and such other information as may be necessary to reasonably apprise the people within the District
of the nature and purpose of the hearing.
C. For an application for a variance, or a series of variances, to be in effect for a period of not more than ninety
(90) days, the clerk of the Hearing Board shall serve a notice of the time and place of a hearing to grant such
a variance upon the Air Pollution Control Officer, all other districts within the basin, the Air Resources Board,
the Environmental Protection Agency, and upon the applicant or permittee, not less than ten (10) days prior to
such hearing.
D. For an application for an interim variance, the clerk of the Hearing Board shall serve reasonable notice of
the time and place of a hearing upon the Air Pollution Control Officer and upon the applicant.
E. For an application for an emergency variance, the clerk of the Hearing Board shall serve notice of the time
and place of the hearing upon the Air Pollution Control Officer and upon the applicant.
F. The clerk of the Hearing Board shall serve notice of time and place of a hearing either by personal services,
or by first-class mail, postage prepaid. If either the identity or address of any person entitled to notice is
unknown, the clerk shall serve such person by publication of the notice in the District pursuant to Section 6061
of the Government Code.
G. Sections 42450 through 42454 of the Health and Safety Code, Orders of Abatement, shall apply.
H. For an application for an appeal of denial of emission reduction certification or withdrawal, or for an application
for an appeal of approval of innovative technology, the clerk of the Hearing Board shall serve reasonable notice
of the time and place of a hearing upon the Air Pollution Control Officer and upon the applicant.
