RULE 6.3 - HEARING BOARD MAY IMPOSE OTHER REQUIREMENTS

Upon making specific findings as required by Rule 6.2, the Hearing Board, in accordance with Section 42353 of the California Health and Safety Code, may impose requirements, other than imposed by statute, rule, regulation or order of the District Board, to a variance granted to a specific facility, or to the operations of individual persons.

1. No variance shall be granted if the operation, under the variance, will result in a violation of Rule 2.13 of these Rules and Regulations;
   
   
2. In prescribing other requirements, the Hearing Board shall exercise a wide discretion in weighing the equities involved and the advantages to the residents of the District from air contaminants and the disadvantages to any otherwise lawful business, occupation, or activity involved, resulting from requiring compliance with such requirements.
