KERN COUNTY AIR POLLUTION CONTROL DISTRICT

RULE 110 - ARRESTS AND NOTICES TO APPEAR
(Adopted 4/18/72, Amended 6/30/80, 5/2/96, 7/10/97)

Pursuant to provisions of the California Penal Code, Section 836.5., the following officers and employees are authorized to arrest without a warrant and issue written notices to appear, or issue notices of violation, or notices to comply whenever they have reasonable cause to believe a person has committed a misdemeanor in their presence which is a violation of a Rule or Regulation of the Kern County Air Pollution Control District or a violation of a Section of Division 26 of the California Health and Safety Code of the State of California, or any provision of the Vehicle Code relating to the emission or control of air contaminants:

Air Pollution Control Officer,

Air Quality Engineer Classification,

Air Quality Specialist Classification,

Captains and Chief Officers of the Kern County Fire Department (only for violations of Rule 416 (Open Burning) or Rule 417 (Agricultural Burning)).
