PART 1 GENERAL
1.1 Purpose
The purpose of this Rule is to control emissions from existing Municipal Solid Waste Landfills as required under
the provisions of the Federal Clean Air Act and regulations promulgated by USEPA at 40 CFR Part 60 Subpart Cc.
1.2 Applicability
The provisions of this Rule shall apply to any Municipal Solid Waste Landfill that has a design capacity of greater
than 2.5 million cubic meters (3.27 million cubic yards) and that has accepted waste at any time since November
8, 1987, or has additional design capacity available for future waste deposition.
1.3 Exemptions
Any Municipal Solid Waste Landfill that is subject to the requirements of the New Source Performance Standard Subpart
WWW - Standards of Performance for Municipal Solid Waste Landfills (40 CFR Part 60.750) is exempt from the requirements
of this Rule.
1.4 Effective Dates
The requirements of this Rule shall become effective on October 16, 1996.
1.5 References
The requirements of this Rule arise from the provisions of the Federal Clean Air Act and its amendments (42 U.S.C
Section 7401 et seq.); and USEPA regulations setting forth emission guidelines for Municipal Solid Waste
Landfills (Final Rule, 40 CFR Part 60.30c).
PART 2 DEFINITIONS
Unless otherwise defined within this Part, the definitions used for the purposes of this Rule shall be those given in 40 CFR Section 60.751.
2.1 Administrator
Shall mean the Air Pollution Control Officer (APCO) of the Monterey Bay Unified Air Pollution Control District
except that the APCO shall not be empowered to approve:
2.1.1 alternative or equivalent test methods; or
2.1.2 alternative standards or work practices unless included in the site-specific design plan as required in 40 CFR Section 60.752(b)(2)(i).
PART 3 REQUIREMENTS
The provisions of Sections 60.751 - 60.759, Chapter I, Title 40 of the Code of Federal Regulations
(40 CFR Sections 60.751 - 60.759), are incorporated herein as the requirements of this Rule. Applicable provisions
of 40 CFR Sections 60.751 - 60.759 include those incorporated in the current bound CFR volume plus any provisions
recently promulgated by USEPA, as noticed in the Federal Register, but not yet incorporated into the bound CFR.
