RULE 406 - COMPLETENESS OF APPPLICATION

Within 30 days after receiving an application for Authority to Construct, the Air Pollution Control Officer shall
advise the applicant in writing whether the application is complete. If an application is deemed incomplete, the
Air Pollution Control Officer shall notify the applicant of the additional information requirements. Failure to
notify the applicant in writing of the completeness of the application shall be deemed acceptance of the application
as complete. If the applicant fails to submit such requested information, the Air Pollution Control Officer may
deny the application. Upon resubmission of an application, a new 30 day review period shall commence. After the
Air Pollution Control Officer accepts an application as complete, he shall not subsequently request of an applicant
any new or additional information which was not specified in the application form and information list. While an
application is being processed after being deemed complete, the Air Pollution Control Officer may require the applicant
to clarify, amplify or supplement the information supplied.
For major sources subject to Title V of the Clean Air Act of 1990, subsection 5.1 of Rule 522 Title V - Federal
Operating Permits applies to completeness reviews.
