SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT
RULE 105 - AUTHORITY TO ARREST
(Adopted January 9, 1976)
The Air Pollution Control Officer and every officer and employee of the South Coast Air Quality Management District
designated by him is authorized, during reasonable hours, to arrest a person without a warrant, whenever he has
a reasonable cause to believe a person has committed a misdemeanor in his presence which is a violation of the
Health and Safety Code or any provision of the Vehicle Code relating to the emission or control of air contaminants
or any order, regulation, or rule adopted thereto. Authority to arrest is granted in accordance with Penal Code
Section 836.5.
