RULE 3007 - EFFECT OF PERMIT
(Adopted October 8, 1993)
(a) Effect of Permit
- A Title V permit does not convey property rights of any sort, or any exclusive privilege.
- A written authorization to construct, issued as part of a Title V facility permit, shall be deemed a permit
to construct for the purposes of all other District Rules and Regulations.
- A written authorization to operate equipment, issued as part of a Title V facility permit, shall be deemed
a permit to operate for the purposes of all other District Rules and Regulations.
- A Title V facility permit shall have all the rights delineated in Regulation II for permits including the right
of appeal.
(b) Severability
A challenge to any permit condition or requirement raised by EPA, the facility owner or operator, or any other
person, shall not invalidate or otherwise affect the remaining portions of the Title V permit.
