SAN LUIS OBISPO COUNTY AIR POLLUTION CONTROL DISTRICT
RULE 802. - FILING PETITIONS

- Requests for hearings shall be initiated by the filing of a petition in triplicate with the Clerk of the Hearing
Board at the Office of the County Clerk, 1144 Monterey Street, Suite A, San Luis Obispo, California, or elsewhere
as designated by the Air Pollution Control Officer from time to time, and the payment of the fee provided for by
resolution of the District Board after service of a copy of the petition has been made on the Air Pollution Control
Officer (APCO) at 3433 Roberto Court, San Luis Obispo, California, and one copy on the holder of the permit or
variance, if any, involved. Service may be made in person or by mail, and service may be proved by written acknowledgment
of the person served or by the affidavit of the person making the service.
- The APCO may file a petition to request the Hearing Board to hold a public hearing to determine whether an
Authority to Construct, a Permit or a Variance should be revoked.
- No fee shall be required for the filing of a petition by a public agency or by a public officer acting in the
scope of his official capacity.
