RULE 6.5 - STANDARDS FOR GRANTING APPLICATIONS
- The designated agency shall grant the permit to burn if the applicant shows that the proposed fire will violate
these Rules and Regulations or Sections 41852 and 41854 of the Health and Safety Code; however, if the application
is for authorization to burn on no burn days, or to burn within three miles of a populated area when the wind direction
is toward the populated area, the designated agency shall refer the application to the Air Pollution Control Officer,
who shall grant the application if he finds denial of the permit would threaten imminent and substantial financial
loss.
- Burning permits will be issued on a quarterly basis with restrictions for shorter times at the discretion of
the Air Pollution Control Officer and issuing agency. Permits may cover any land area by the same permittee within
a given agency's area.
