§ 39003. State Air Resources Board

The State Air Resources Board is the state agency charged with coordinating efforts to attain and maintain ambient air quality standards, to conduct research into the causes of and solution to air pollution, and to systematically attack the serious problem caused by motor vehicles, which is the major source of air pollution in many areas of the state.

Former Sections: Former § 39003, similar to present § 39023, was added by Stats 1967 ch 1545 § 5 and repealed by Stats 1975 ch 957 § 11.

Attorney General's Opinions: The California Air Resources Board is authorized to adopt motor vehicle emission control system warranty regulations as set forth in 13 Cal. Admin. Code, §§ 2035-2046. 64 Ops. Cal. Atty. Gen. 425.

NOTES OF DECISIONS

In the light of practical considerations, as well as the purposes and provisions of the Mulford-Carrell Air Resources Act (former H & SC §§ 39000 et seq.), the Legislature intended to accord the power to regulate the lead content of gasoline to the statewide Air Resources Board, rather than to air pollution control districts established under former H & SC §§ 24198 et seq. (Disapproving Environmental Defense Fund v.California Air Resources Board (1973) 30 Cal App 3d 829, 106 Cal Rptr 598, 1973 Cal App LEXIS 1208.) Western Oil & Gas Asso. v.
