Part 4 Nonvehicular Air Pollution Control

Chapter 1 General Provisions

§ 41500. Duties of state board

To coordinate air pollution control activities throughout the state, and to ensure that the entire state is, or will be, in compliance with the standards adopted pursuant to Section 39606, the state board shall do all of the following:
(a) Review the district attainment plans submitted pursuant to Section 40911, and the revised plans submitted pursuant to Section 40925, to determine whether the plans will achieve and maintain the state's ambient air quality standards by the earliest practicable date.
(b) Review the rules and regulations and programs submitted by the districts pursuant to Section 40704 to determine whether they are sufficiently effective to achieve and maintain the state ambient air quality standards.
(c) Review the enforcement practices of the districts and local agencies delegated authority by districts pursuant to Section 40717 to determine whether reasonable action is being taken to enforce their programs, rules, and regulations.

Former Sections: Former § 41500 was added by Stats 1st Ex Sess 1975 ch 1 § 7, effective September 26, 1975, amended by Stats 1977 ch 926 § 5, and renumbered § 51230 by Stats 1978 ch 380 § 98.

Amendments:

1976 Amendment: (1) Added “, or will be,” before “in compliance” in the introductory clause; (2) substituted “state's” for “adopted” before “ambient” in subd (a); and (3) substituted “programs” for “plans” wherever it appears in subds (b) and (c).

1988 Amendment: (1) Amended the introductory clause by (a) substituting “ensure” for “insure” after “state, and to”; and (b) adding “do all of the following”; (2) substituted subd (a) for former subd (a); (3) amended subd (b) by substituting (a) “Section 40704” for “Sections 40704 and 41603”; (b) “they are sufficiently effective” for “the rules and regulations and programs assure that reasonable provision is made”; and (c) “the state” for “such” near the end; and (4) amended subd (c) by (a) adding “and local agencies delegated authority by districts pursuant to Section 40717”; and (b) substituting “their” for “such” near the end.

1992 Amendment: Added “or 40717.2” after “Section 40717” in subd (c).

2000 Amendment: Deleted “or 40717.2” after “Section 40717” in subd (c).
