On November 8, 2004, the Final Regulation Order for the Airborne Toxic Control Measure for Stationary Compression Ignition Engines was approved by the Office of Administrative Law and filed with the Secretary of State. The rulemaking will become operative December 8, 2004.

On November 10, 2004, the Final Regulation Order for the Airborne Toxic Control Measure for In-Use Diesel-Fueled Transport Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate was approved by the Office of Administrative Law and filed with the Secretary of State. The rulemaking will become operative December 10, 2004.

The Final Rulemaking Package for the Stationary Compression-Ignition Airborne Toxic Control Measure was filed with the Office of Administrative Law (OAL) on Friday, September 24, 2004. OAL has until November 8, 2004 to make a determination. The adopted regulation and materials submitted to OAL are available on the regulatory documents page.

The Air Resources Board (Board or ARB) will conduct a public hearing on February 26-27, 2004, to renew consideration of the proposed airborne toxic control measures (ATCM) for stationary compression-ignition engines and transport refrigeration units (TRU) that were initially considered in November and / or December 2003, but for which the Board delayed final action on the regulations in consideration of Executive Order S-2-03. CANCELLATION - TRU Public Workshop on 8/26/03: The Transport Refrigeration Unit (TRU) Workshop that was scheduled for August 26, 2003, has been canceled. The Board adoption date of the TRU Airborne Toxic Control Measure has been postponed to December. Currently, staff is internally discussing additional technology development strategies for reducing diesel particulate matter and hydrocarbon emissions. Once our initial concepts are developed, we will schedule a TRU Workgroup meeting for some time in September to discuss possible regulatory approaches.

We have added summaries from the U.S. EPA Large Engine (On-Highway and Nonroad Compression-Ignition) Certification Data for 2001 Model Year, identifying engines which have PM emissions of < 0.149 g/bhp-hr.
