Administrative Hearings


An Administrative Hearing offers a means by which to contest a citation for a party who has been issued a citation under the Air Resources Board's (ARB's) Heavy Duty Diesel Inspection Program. The hearing is conducted by an administrative law judge and must be conducted in accordance with the ARB's Administrative Hearing Regulations. Under the administrative hearing procedures, the party receiving the citation and penalty assessment has the option of either paying the penalty within a certain timeframe or requesting an administrative hearing. If the party chooses not to pay and does not request a hearing, additional penalties will be imposed and the ARB may proceed to the Superior Court to obtain a judgment for the amount of the penalty. Citations included under this program include citations for excessive smoke, tampering, and missing emission control labels.

Contest an ARB Issued Citation:
