Exotica Fragrance Case Settles for $2,499

On December 21, 2010, OLA and ED staff participated in a Small Claims Court case involving consumer products manufactured by Exotica Fragrance that were not marked with a date of manufacture. The Consumer Products Regulation requires all regulated consumer products be marked with a date of manufacture or a date code. The manufacturer was issued a Notice of Violation and a monetary settlement could not be agreed upon. At the Small Claims Court, the defendant was a no-show and the presiding judge made a decision in favor of ARB. This case was settled for $2,499.
