In November 2012, the Air Resources Board (ARB) reached a settlement with Kohler Power Systems (Kohler) that included a one-time payment of $58,875 to the California Air Pollution Control Fund for self-reported sales of 157 small off-road engines prior to certification for the years 2010, 2011, and 2012.
Kohler did obtain certification and Executive Orders during the years 2010, 2011, and 2012 for the small off-road engine family involved in this case. Kohler has taken steps to avoid this type of error in the future. Kohler self-reported the error and was very cooperative and forthcoming with information to ARB. To settle the case, Kohler agreed to the $58,875 penalty.
