MotorScience Enterprises, Inc. Case Settles for $722,000

Motor Science provides certification consulting services to manufacturers and importers of motor vehicles and engines. The test data and applications Motor Science submitted to obtain ARB and USEPA certification were scrutinized by ARB investigators. Since false information was submitted to obtain certification, ARB revoked the Executive Orders ab initio for 10 engine families that were certified by Motor Science, rendering any sales of these vehicles illegal. This was a joint investigation with USEPA.
A court-ordered mediation was held on December 14, 2012. A settlement was reached in favor of ARB for $722,000. The settlement also included a Consent Decree. The Consent Decree includes an extensive compliance plan, which requires defendants to provide notice of all mobile source work not involving nonroad vehicles and nonroad engines. The court entered the Consent Decree on January 9, 2014.
