In July 2011, the ARB reached a settlement with Wilson’s Motorcycles located in Fresno California that included a $2,500 penalty to the California Air Pollution Fund for offering for sale one Aprilia motorcycle that was not certified for use or sale in California. An investigation by the ARB showed that sometime before November 2010 Wilson’s Motorcycle modified a new 2008 Aprilia motorcycle by removing all of the emission control equipment and reprograming the computer and then offered it for sale on their showroom floor. The modifications made to the new 2008 motorcycle rendered it uncertified and illegal for sale in California and was in violation of Health and Safety Code sections 43151 through 43153. Wilson’s restored the motorcycle to its original certified condition. The case settled in July 2011, for Two Thousand Five Hundred Dollars ($2,500).
