| This page contains information for anyone planning to request a variance from a local air pollution control district hearing board. The first step in requesting a variance is to contact your local Air Pollution Control District. There are six findings that the hearing board must make prior to the granting of anyvariance as specified in Health & Safety Code HSC §42352 . The burden of proof rests on the person requesting the variance. Proof may include presenting witnesses that have first-hand knowledge of the situation. Proper preparation prior to the hearing is critical. |
