Final Rulemaking Package
for the Amendments to the Regulation (November 8, 2011)
- Staff have posted the Final
Rulemaking Package for the amendments to the
regulation.
The package was filed with the Office of Administrative Law (OAL) on
October 28, 2011, and OAL has until December 14, 2011, to make a
determination. The package includes the Final Statement of
Reasons which includes ARB's responses to all comments received on the
regulation during the public comment periods.
Advisory on the Delay or
Suspension of the Installation of Particulate Matter (PM) Filters
(September
30, 2011)
- MSC
Mail-Out 11-29 has been posted to address
compliance, including early action credit
eligibility, when a manufacturer of a verified diesel PM filter
suspends sales and installations of a PM filter, or
requires its removal for a particular engine
family.

- The

Compliance Assistance
Tool (August 5, 2011)
- Staff has posted an updated version of the Fleet
Calculator. The Fleet Calculator is an Excel
spreadsheet to assist
fleet owners in evaluating various compliance strategies to comply with
the
Truck and Bus regulation. Fleet owners can view
automated
compliance strategies for meeting the compliance schedule based on
engine model
year or can evaluate more flexible compliance strategies including the
PM
filter phase-in option, compliance credits, and special
provisions. The
tool has been updated to reflect the amendments considered by the Board
in
December 2010 and reflects details addressed as part of the 15 day
public comment
period.

is now available that provides an overview of the regulation consistent

Enforcement Advisory
regarding to the Postponement of
Reporting
Deadline and Administrative Changes (April 15,
2011)
- Enforcement
Advisory 427
explains administrative changes in implementing the requirements of the
Truck and Bus Regulation. The reporting date for agricultural
vehicles and two-engine sweepers has been postponed from March 31, 2011
to April 29, 2011. The definition of “Farming Business” was clarified
to allow farm management companies, that do not own or lease land, to
take
advantage of the agricultural vehicle provisions. The
advisory
also addressed specialty vehicle exemptions, and the date for
labeling the agricultural vehicles.
Reporting Date Postponed
Until April 29, 2011 for
agricultural
fleets and fleets with street sweepers with Tier 0 engine
(March 22,
2011)
- The March 31, 2011 reporting date for agricultural fleets
and
fleets with street sweepers with Tier 0 auxiliary engines is
being postponed until April 29, 2011 to give fleets more time to
report. California Air
Resources Board staff is preparing an advisory to reflect the
change and will be updating related documents in the near
future.
Compliance Assistance Tool
(February 23,
2011)
- The Fleet
Calculator
is an Excel spreadsheet to assist fleet owners in evaluating various
compliance strategies to comply with the Truck and Bus Rule. It allows
the user to input the engine model year, and emission control
technology assumptions to determine what compliance options may be
available to comply with the regulation for each calendar
year.
Fleets can view automated compliance strategies for meeting the
compliance schedule based on engine model year or can evaluate more
flexible compliance strategies including the phase-in option,
compliance credits, and special provisions. The tool is
consistent with amendments considered by the Board in December 2010.
Agricultural Provisions
Reporting Information (February 10, 2011)
- The online
reporting system
is now available for agricultural fleets to report.
Agricultural
fleets that reported in 2010 can login to the online system to provide
January 1, 2011 odometer readings and update vehicle information for
2011. Fleets that are reporting for the first time can create
an
account and enter their information directly online without using paper
reporting forms. The user
guide provides information on how to report and has the paper
reporting forms.

is available that summarizes the agricultural vehicle provisions
consistent with
amendments considered by the Board at the December
17, 2010, Board Hearing.

Meeting on Emissions Inventories for Trucks, Buses, and Off-Road
Equipment (Posted November 4, 2010)
- The Air Resources Board will conduct a public meeting
on November 18, 2010, to hear a report on updates to emissions
inventories for trucks, buses, and off-road equipment prior to
considering amendments to the Truck and Bus and the off-road
regulations at a hearing scheduled
in December 2010. This
informational item for the November meeting focuses only on the
emissions inventory activity and emissions data and methods, and not
the proposed regulatory amendments which will be considered in
December. Comments on the emission inventory used to
support
the proposed amendments to the Truck and Bus and Off-Road regulations
may be submitted here.

- The Air Resources Board will conduct a public hearing
on December 16 or 17, 2010, in Sacramento, to discuss proposed
amendments to on-road and off-road regulations to reduce emissions
from diesel vehicles. Specifically, the Board
will consider
proposed amendments to the Truck and Bus, Drayage
Truck, and Tractor-Trailer GHG on-road regulations. The public hearing

web page. ARB staff has posted additional supporting
documentation and analyses for the proposed amendments to the Truck and

Agenda for the August/September Workshops is Online
(Posted

- Please note that the agenda for
these
workshops have changed.
Staff will not be providing new
regulatory proposals
at this time. Instead, staff will be soliciting feedback on the revised
emission inventories used when developing
the Regulation for In-Use Off-Road Diesel Fueled Fleets (off-road
regulation), the In-Use Heavy-Duty Diesel-Fueled
Vehicles Regulation (truck and bus regulation), and the In-Use On-Road
Diesel-Fueled Heavy-Duty Drayage Trucks Regulation
(drayage truck regulation). Additionally, staff will give a
presentation summarizing the recently released report:
"Estimate of premature deaths associated with fine particle pollution
(PM2.5) in California based on U.S. EPA's methods".
Finally, staff will hold an open comment period to solicit suggestions
for further regulatory amendments, given the recently
available information discussed in the workshop. Workshops on revised
staff regulatory proposals will be held in
September/October, 2010. To accommodate this additional series of
workshops, and to provide time for public comment, staff
will delay proposing regulatory amendments to the Board
until December 2010.
The hard copy materials will also be available at each location on the
day of the meeting.
Changes in Upcoming Diesel Workshops

- Staff of the Air Resources Board (ARB) is making some
changes to
the upcoming series of 5 statewide workshops
pertaining to the Regulation for In-Use Off-Road Diesel Fueled Fleets
(off-road regulation), the In-Use Heavy-Duty Diesel-Fueled Vehicles
Regulation (truck and bus regulation), and the In-Use On-Road
Diesel-Fueled Heavy-Duty Drayage Trucks Regulation (drayage truck
regulation).
Staff is
postponing
tomorrow’s
workshop in Fresno (August 26th) to Friday, September 3, 2010.
The time and locations of the workshop, including videoconferencing
with Bakersfield and Modesto, remains unchanged.

At
all of the workshops, staff will provide an update on the changes to
the emissions inventories underlying the off-road regulation, the truck

planned. However, ARB staff needs additional time to evaluate
and
explore appropriate regulatory proposals and consider their economic
impact on affected stakeholders, determine the effect of any changes on
emissions over the next decade, and determine how to best protect
public health in light of the health impacts of fine particle pollution
(PM2.5) currently underway. Once this work is complete, ARB
staff
will schedule additional workshops regarding the modified proposals so
that we may receive stakeholder feedback and comments on the proposed
amendments.

Delay of Board
Hearing to
November for Consideration of Amendments to the Truck and Bus,
Off-Road, Tractor-Trailer GHG, and Drayage Truck Regulations (Posted
August 3,
2010)
- Staff held workshops in June and July regarding
proposed
amendments to the Truck and Bus, Off-Road, Tractor-Trailer GHG, and
Drayage Truck regulations. At the workshops, stakeholders
requested additional time to review and comment on the
following:
• Details of planned emissions inventory
updates for trucks and off-road vehicles,
• Specific draft regulatory language,
• ARB’s revised report on fine
particulate matter (PM2.5) mortality estimates, a draft of which will
be released later this summer, and
• Proposed changes to the Drayage Truck
Regulation.
To address stakeholders’ requests, the Board Hearing to consider the
proposed amendments, currently slated for September 2010, will be moved
to November. In the interim, staff will hold workshops in
August and September to discuss the revised emission inventory and the
proposed amendments. This delay in the hearing date will provide
sufficient time to hold the workshops and to make any necessary
adjustments after the workshops. A workshop notice will be
forthcoming.
Unique Vehicle
Determination for Certain Cab-Over Engine Livestock Truck and Trailer

Training Course for
Diesel Truck, Bus, and Equipment Sellers (Posted
July 9, 2010)
- On July 21st and 22nd, ARB will be providing
training
for sellers of trucks, buses, and trailers that operate in California.
The training will provide an overview of the
regulatory requirements affecting truck, bus, and
trailer owners, tools for compliance assistance, and
seller disclosure requirements. The trainings will be offered
on
July 21 in El Monte and July 22 in Sacramento. The training
course on July 22 will also be available by webcast. If
participants cannot attend one of the scheduled training dates, ARB
staff is offering to host a pre-arranged interactive training where
participants can attend online from remote locations. More

Surveys for
the

have been posted to solicit fleet data, financial
information, input regarding regulatory amendments for the

load factor data. The result of these analyses along with
information obtained from other
sources will help staff craft the proposed modification to the Truck
and
Bus and the Off-Road regulations and evaulate the cumulative effects of
the amendments. Any information that is marked
confidential will remain confidential. The deadline for
submitting the survey information is June 1, 2010. The

The reporting deadline for fleets who wish to take advantage

sweepers with Tier 0 auxiliary engines, is March 31, 2010.
The
training will help all fleets who wish to use ARB's compliance
tools for compliance planning
and reporting. The training seminars will be held at various
locations in the day and in the evening. The training
seminars
will also be webcast on February 16, March 2, and March 18.

At the board hearing held on
December 9, 2009 the California
Air Resources Board (ARB) directed staff to propose amendments to the
Truck and
Bus Regulation that would provide additional flexibility for fleets
adversely
affected by the economy. The
board asked
staff to evaluate alternatives that would meet emission targets and to
focus on
smaller businesses. The Board also asked staff to consider changing the
March
31, 2010 reporting date (except agricultural fleets and fleets with two
engine
sweepers) to provide more time for fleets to submit their vehicle
information. Staff
is now preparing its analysis and will
be drafting suggested amendments for review.
Staff plans to hold public workshops in early 2010 to
obtain stakeholder

Staff
postponed the workshop originally scheduled on October 28 to discuss
the impact of the economy on emissions with the intention of
re-scheduling the workshop to a future date. Staff has now

Advisory Committee (TRAC) Meeting Postponed

Due
to significant public interest in participating in the Truck Regulation
Advisory
Committee (TRAC), we are extending the deadline for applying for
membership to the TRAC to July 27, 2009. In addition, to
allow
staff adequate time to evaluate the membership applications and select
appropriate members, we are postponing the TRAC meeting originally
scheduled for July 28, 2009, in Sacramento, to August 31, 2009.
The time and location of the August 31, 2009 meeting, as well
as
a proposed agenda, will be posted in the near future. Staff
intends to notify applicants by August 10, 2009, of their status on the
TRAC. We apologize for any inconvenience this may have
caused.

are beginning efforts to implement the Truck
and Bus regulation and the Heavy-Duty Diesel Greenhouse Gas Emission
reduction regulation. We are forming a truck regulation advisory
committee (TRAC), which will be an informal committee established to
assist in implementing the regulations. Staff is soliciting
applications for membership to keep the size of the committee
manageable, to allow for productive discussions, and to ensure TRAC
represents a broad and diverse group of stakeholders.
Applications are due by July 15, 2009 and the first TRAC
meeting
will be held on July 28 in Sacramento. Please review the invitation
letter with information on TRAC and the upcoming meeting

Air Resources Board
will be
conducting a public hearing on December 11 and 12, 2008, in Sacramento
to consider the adoption of a proposed regulation to reduce emissions
from in-use on-road diesel vehicles. The Board will also
consider
amendments to the regulation for in-use off-road vehicles, drayage
trucks, municipality and utility vehicles, mobile cargo handling
equipment, portable engines and equipment, heavy duty engines and
vehicle exhaust emissions standards.The meeting notice, staff report,

Statewide On-Road
Capital Cost Model is now available on the fleet
calculator page. The model is a Visual Basic module that runs
within an Access database and utilizes Access queries. The modeling
approach and assumptions are described in detail in Chapter XIII and

Regulation for In-Use On-Road Diesel Vehicles. |

| “Statewide Truck and Bus
Rule”
and the “AB 32 Truck Efficiency Rule” Board Hearing Date Has Changed

ARB
Staff has been working
hard to
finalize its two regulatory proposals to reduce PM, NOx and GHG
emissions from on-road trucks. These proposals are commonly known as
the “Statewide Truck and Bus Rule” and the “AB 32 Truck Efficiency
Rule”. An important part of this effort is to complete our analysis of
the economic impact on the many different types of fleets that will be
affected by these rules. We have also been meeting with many
stakeholders, and are analyzing alternative regulatory proposals some
have offered. Because of this effort, when coupled with the freeze on
overtime associated with the budget impasse, we have concluded we will
not be ready for the October, 2008, Board meeting. As a result, we have
delayed the Board’s consideration of these two regulatory items to its
December 11 & 12, 2008, hearing in Sacramento. |

web page. It is a tool designed to assist
school bus fleet owners in determining compliance strategies to meet
the

to gather information on the use of heavy-duty diesel vehicles in
California. The purpose of the survey is to better understand the age
and use of diesel vehicles used in different operations such as
long-haul, local delivery, and other types of operations. We would like
any person, business or corporation that owns or is leasing, for twelve
months or more, any diesel powered truck, bus, pickup, or other vehicle
to complete the survey. A

heavy-duty diesel vehicles. A workgroup meeting is an informal setting
to brainstorm and exchange information affecting different stakeholder
groups. The meeting will be held on July 18, 2006. At the meeting, we
plan to discuss: treatment of interstate trucks and buses, segmentation
of the industry, and characterization of vehicle trips and quality of
data sources. We also would like to discuss strategies used in
previously adopted control measures affecting heavy-duty vehicles and
preliminary control measure concepts for consideration in this control
measure. Staff would like to solicit feedback from all interested
parties on which approaches seem most effective, feasible, and
enforceable. |
