The Rule for On-Road Heavy-Duty Diesel-Fueled Public
and Utility Fleets is one of the California Air Resources Board's efforts to reduce both criteria pollutant emissions
and exposure to toxic air contaminants. The rule mandates Public Agency and utility vehicle owners reduce diesel
PM emissions from their affected vehicles through the application of Best Available Control Technology or BACT
on these vehicles by specified implementation dates. Implementation is phased-in by engine model year groups.

| ARB Adds
a Training Seminar on The Fleet Rule for Public Agencies and Utilities
- In addition to training seminars held in Santa Ana and to be
held in Alameda, ARB has added a training seminar on October 24, 2007, in Redding. The Fleet Rule for
Public Agencies and Utilities became effective January 5, 2007, which requires municipalities and utilities to
apply best available control technology to diesel powered heavy-duty vehicles in their fleet. For information on

Retirement of Public Agency and Utility Vehicles - The Air Resources Board developed documents for municipalities and utilities to
insure the proper "retirement" of a vehicle. |

Agency and Utility Training Seminars - The Fleet Rule for Public Agencies and Utilities became effective January 5, 2007, which
requires municipalities and utilities to apply best available control technology to diesel heavy-duty vehicles
in their fleet. To assist municipalities and utilities with their compliance efforts, the Air Resources Board will
present two (2) "training seminars" during the months
of September and October. These seminars are designed to provide an opportunity for municipalities and utilities
to learn about the regulation and to learn about types of devices and strategies available to assist with compliance. |

Diesel Vehicle and Engine Labeling Requirements - Revised Enforcement Advisory
Number 354 is now available. Owners/operators of on-road heavy-duty
diesel vehicles should be aware of the engine, vehicle, and verified diesel emission control strategies, labeling
requirements of the Air Resources Board's programs and regulations. |

Resources Board encourages county and city government officials to support their fleet administrators efforts - The Air Resources Board issued
a letter encouraging county and city government officials to support their fleet administrators
in complying with the Fleet Rule for Public Agencies and Utilities. Compliance with the regulation is important
to fleet operators to not only reduce diesel soot emissions from their diesel-fueled fleet, but also to avoid costly
penalties associated with non-compliance. The first implementation deadline for the regulation is December 31,
2007, where 20 percent of diesel-fueled vehicles subject to the regulation with 1960 through 2002 model year engines
must have best available control technology applied. |

MSC 07-15 regarding proper selection of ARB verified diesel emission control strategies (DECS) - Before purchasing an ARB verified DECS, it is highly recommended that fleet
operators read the applicable verification Executive Order for the
DECS to be purchased. DECS installed on inappropriate engines, vehicles, and/or applications, or operated in a
manner that is not compliant with the Executive Order are not verified configurations. Such configurations will
not satisfy the BACT requirement of ARB fleet rules, and could expose owners of affected vehicles or equipment
to potentially significant civil penalties and fines. |

| ARB's Fleet Rule
for Public Agencies and Utilities effective January 2007 - In February 2007, the Air Resources Board determined, per the doctrine of sovereign
immunity (Section 118(a) of the Clean Air Act), that federal agencies are not covered by the Fleet Rule for Public
Agencies and Utilities, as set forth in title 13, California Code of Regulations, sections 2022 and 2022.1. Enforcement Division
Advisory Number 362 provides an overview of the regulation, and
the applicability for federal fleets. |

| Diesel emission
control strategies (DECS) now available for Public Agency and Utility Group 1 vehicles - Verified DECS are now available for
Group 1 engines to meet BACT. The Air Resources Board (ARB) has recently issued Advisory, MSC 07-10, concerning
compliance extensions for Group 1 municipal and utility vehicles. During the ARB training seminars on the Fleet
Rule for Public Agencies and Utilities in October and November 2006, verified devices were not available for Group
1 engines. ARB discussed the possibility of providing a blanket compliance extension for Group 1 engines. ARB will
not be providing a blanket compliance extension for Group 1 engines because DECS are now available. |
