Background 
This area of the Off-Road Mobile Sources website pertains to regulatory activities to reduce diesel particulate matter (PM) and oxides of nitrogen (NOx) emissions from diesel-fueled cargo handling equipment at California's ports and intermodal rail yards. Cargo handling equipment is used to transfer goods or perform maintenance and repair activities and includes equipment such as yard trucks (hostlers), rubber-tired gantry cranes, top handlers, side handlers, forklifts, and loaders, just to name a few. The Air Resources Board adopted a regulation for mobile cargo handling equipment at ports and intermodal rail yards on December 8, 2005, and the regulation became effective on December 31, 2006. As part of our continuing efforts to reduce greenhouse gas (GHG), diesel PM, and NOx emissions in California, the Air Resources Board staff is investigating opportunities to reduce idling emissions from cargo handling equipment used at ports and intermodal rail yards.  Activities related to this effort will be posted on this site.

bulletARB has posted a Notice of Disclosure Requirements for renters, dealers and sellers of Mobile Cargo Handling Equipment (CHE) at ports and intermodal rail yards.  This notice reminds renters, dealers and sellers of CHE at ports and intermodal rail yards of the disclosure requirements, adopted in 2011, for equipment with engines certified to Tier 4 Alternate PM off-road engine standards.

bulletARB will be holding two informational meetings on the implementation and enforcement of the 2011 Amendments to the Mobile Cargo Handling Equipment at Ports and Intermodal Rail Yards (CHE Regulation).  These meetings are to answer questions from owners/operators and renters/dealers/sellers of CHE regarding these newly enforceable ammendments.  Two meetings will be held; one in Southern California and one in Northern California.  ARB staff will provide the same information at each meeting.  Additional detail is available in the notice.

bullet ARB has received United States Environmental Protection Agency (U.S. EPA) authorization to enforce the 2011 Amendments to the Cargo Handling Equipment Regulation, including new opacity based monitoring and new retrofit requirements for engines certified to U.S. EPA Tier 4 Family Emission Limit (FEL) Altermate PM standards.  Regulatory Advisory 311 informs owners and operators of mobile cargo handling equipment at ports and intermodal rail yards as to how ARB staff will proceed with the enforcement of these provisions.

bullet The Office of Administrative LAW (OAL) has approved the Amendments to the Regulation for Mobile Cargo Handling Equipment at Ports and Intermodal Rail Yards (section 2479 of title 13, California Code of Regulations).  OAL approved the rulemaking and filed it with the Secretary of State on September 14, 2012. The amendments to the regulation will become effective on October 14, 2012. The final text of the regulation is available at the following:

bullet The Office of Administrative Law approved amendments to the Cargo Handling Equipment Regulation, effective December 3, 2009.  The amendments exempt sweepers and mobile cranes (other than rubber-tired gantry cranes) from the Cargo Handling Equipment Regulation, placing them under either the In-Use Off-Road Diesel Vehicle Regulation or the In-Use Heavy-Duty Diesel Vehicle Regulation (On-Road Truck and Bus Regulation), depending on the engine configuration (please refer to the table to determine which rule would apply to the various engine configurations).  The amended regulation is available in two styles below:
