Description: The proposed regulations would establish certification procedures for aftermarket parts and alternative fuel conversion systems for off-road mobile sources, and would amend the warranty regulations for currently regulated off-road mobile sources to allow the sale, offer for sale, and installation of aftermarket parts that have been exempted pursuant to the proposed certification procedures. In addition, the regulations would establish anti-tampering provisions for off-road mobile sources that are analogous to the anti-tampering provisions applicable to on-road mobile sources.

Adoption of Emission
Standards and Test
Procedures for New 2001
and Later Spark-Ignition
Marine Engines

Description: This proposal would adopt emissions standards that are progressively more stringent than U.S. EPA's standards in 2001, 2001, and 2008 and would include related provisions including enforcement and consumer information. The proposal would be implemented with outboard and personal watercraft marine engines produced in the 2001 and later model years, would not apply to inboard or sterndrive engines. The proposed regulation is designed to harmonize as closely as possible with the federal program (Title 40, Code of Federal Regulations, Sections 89 through 91, October 4, 1996).

  Status: The Hearing Notice was published October 23, 1998, for a hearing on December 10, 1998, at 8:30 a.m. in the Air Resources Board Hearing Room in Sacramento, California. At 8:00 a.m. on the day that this item will be considered, a demonstration of marine engine technologies will be conducted on the north side of ARB's 2020 L Street building in Sacramento. The final regulation package was filed with OAL on October 22, 1999. OAL approved all sections of the regulation except Section 23013. The ARB adopted the final regulation order for Section 2443.3 on June 14, 2000, and submitted it to the OAL June 15, 2000. The OAL approved the final regulation package on July 10, 2000, and filed it with the Secretary of State the same day. Section 2443.2 became effective on August 9, 2000.

Amendment to the
Specifications for
Liquefied Petroleum
Gas in Motor Vehicles

Description: The proposal would retain the current interim limit of 10.0 percent by volume as a permanent limit for the propene content of LPG sold commercially for use in motor vehicles; under the existing regulation, a 5.0 percent by volume is scheduled to become applicable January 1, 1998. The proposal would also raise butane-and-heavier limit from 2.5 to 5.0 percent by volume, and add a 0.5 percent by volume for butenes and heavier.

Standards for
On-Road Motorcycles

Description: In this rulemaking, Board staff proposes amended emission standards for on-road motorcycles. The amended standards are phased in with Tier 1 being effective in model year 2004 (1.4 g/km HC+NOx) and Tier 2 being effective in model year 2008 (0.8 g/km HC+NOx). The proposed standards provide for corporate averaging, small-volume manufacturer treatment, and incentives for early compliance as described.

Description: The proposal seeks to modify the existing off-highway recreational regulations to allow limited usage of vehicles that do not meet the applicable emissions standards in California's off-highway vehicle riding areas. The proposal would restrict the use of such noncomplying vehicles during the smog season at off-highway vehicle areas located in smoggy areas. The amended regulations would apply to all California off-road motorcycles and all-terrain vehicles manufactured on / after January 1, 1997.

Description: California's 1994 State Implementation Plan (SIP) for Ozone contains measure M1 which calls for the voluntary accelerated retirement of large numbers of older, higher-emitting vehicles in the South Coast Air Basin from 1999 through 2910. The SIP commits the M1 program to achieving a 25 ton per day reduction in emissions of reactive organic gases and oxides of nitrogen in 2010. California Health and Safety Code section 44100 et seq., Article 10, requires the ARB to adopt regulations governing the implementation of market-based privately operated voluntary accelerated vehicle retirement enterprises.

Description: The proposed amendments would revise the definition of Low Vapor Pressure - Volatile Organic Compounds (LVP-VOCs), including specifying a method for determining whether a compound or mixture is an LVP-VOC. The proposed amendments would also modify ARB Method 310, Determination of Volatile Organic Compounds (VOC) in Consumer Products, including incorporation by reference of additional methods to be used for determining the LVP-VOC content of consumer products.

Amendments to LEV II" and
"CAP 2000" Regulations

Description: Consideration of a comprehensive set of "LEV II" amendments to the California Low Emission Vehicle (LEV) regulations, including the application of passenger car exhaust emission standards to most sport utility vehicles (SUVs), pick-up trucks and mini-vans, lower tailpipe standards for all vehicles, more stringent requirements for phasing in cleaner vehicles, an up to 80 percent reduction in most evaporative emission standards, additional mechanisms for the generation of zero-emission vehicle (ZEV) credits, and numerous technical modifications. The amendments are designed to meet the ARB's commitment to achieve emission reductions from light-duty vehicles under the State Implementation Plan (SIP) for ozone attainment. The Board will also consider "CAP 2000" amendments to the certification and in-use compliance requirements for motor vehicles.

Description: A proposal to add diesel exhaust to the list of toxic air contaminants with no identified threshold exposure level below which no significant adverse health effects are anticipated.
Affected Regulations: Amendment to Section 93000, Title 17, California Code of
Regulations.
  Status: The public hearing to consider adoption of a regulatory amendment identifying diesel exhaust as a toxic air contaminant on July 30, 1998, at 9:30 a.m. was continued to August 27, 1998, at 9:30 a.m. in the Air Resources Board Hearing Room in Sacramento. The Board directed the Executive Officer to make modifications, as specified, and notice for 15-days. The Notice of Public Availability of Modified Test was made available October 13, 1998, with October 28, 1998, being the deadline for public comment. Description: The proposed amendments would amend the existing aerosol coatings regulation by revising the volatile organic compound (VOC) limits for 23 categories of aerosol coatings. In addition, the future effective date of the VOC limits for all 35 categories of aerosol coatings would be postponed by two years, until January 1, 2002. Finally, the proposed amendments would exempt methyl acetate from the VOC definitions in the aerosol coatings regulation, the antiperspirant and deodorant regulation and the consumer products regulation.

Affected Regulations: The proposed regulation adds new Sections 60090 through 60095 to Title 17 of the California Code of Regulations. The purpose of this regulation is to implement the provisions of section 39150 et. seq., of the California Health and Safety Code, which require the ARB to classify "minor violations" and establish guidelines for issuing a Notice to Comply.
  Status: Hearing notice published March 6, 1998, for the Public Hearing held on April 23, 1998. The originally proposed regulation had 15-day changes which were made available August 1, 1998 through August 16, 1998. An Errata was distributed and extended the public comment period to August 25, 1998. The final rulemaking package was filed with OAL on February 26, 1999. OAL approved the regulations on April 8, 1999, and filed them with the Secretary of State. The regulations will become effective 30 days from that date which is May 7, 1999.

The final package was filed with Office of Administrative Law on February 5, 1999, and approved on March 23, 1999. The effective date of the regulation is March 23, 1999.

  Status: The regulation package was filed with the Office of Administrative Law (OAL) on June 17, 1998, as an emergency regulation and approved as an emergency regulation on June 26, 1998. The Certificate of Compliance and final regulation package was filed with OAL on September 4, 1998, and approved on October 19, 1998.

California Cleaner
Burning Gasoline
Regulations

Description: Amendments to the California cleaner-burning gasoline regulations to rescind in some areas the wintertime minimum oxygen content standard, to increase the maximum oxygen content limit allowable under the Predictive Model from 2.7 percent wt. to 3.5 percent wt., and to make other technical changes.
Affected Regulations: Amendment to Sections 2260 to 2262.7, Title 17, California Code of Regulations
  Status: At the August 27, 1998 hearing, the Board adopted all of the amendments proposed except for increasing the maximum oxygen content cap. The Board continued consideration of this remaining element until December 10-11, 1998. The adopted amendments were submitted to OAL on September 4, 1998, with a request for expedited review and an immediate effective date upon filing with the Secretary of State. OAL approved the amendments on September 21, 1998, and they became effective on the same date.
  At the continued December 11, 1998 hearing, the Board adopted the remaining amendment increasing the oxygen content cap from 2.7 to 3.5 percent by weight. This final portion of the rulemaking was filed with OAL on March 5, 1999. OAL approved the final portion on March 31, 1999, and the regulations became effective on the same date.

  Status: The hearing notice, proposed amendments and associated documents were published on December 12, 1997, and the Board adopted the amendments at the January 29, 1998, hearing as proposed. The rulemaking package was filed with OAL on March 4, 1998. OAL approved and filed the package with the Secretary of State on April 14, 1998, and the amendments became effective on that date.
