REGULATION II - PROHIBITIONS

RULE 2.26 - ARCHITECTURAL COATINGS
(amended 5/21/91)

a. APPLICABILITY

This rule is applicable to any person who sells, offers for sale or applies any architectural coating.

b. EXEMPTIONS

Subsection c., of this rule, shall not apply to:

  1. Architectural coatings sold in the Colusa County Air Pollution Control District for shipment outside of the District or for shipment to other manufacturers for repackaging.
  2. The following coatings:

    A. Architectural coatings supplied in containers having capacities of one liter or less;

    B. Architectural coatings recommended by the manufacturer for use only as one or more of the following: dry fog coatings; fire retardant coatings; tile like glaze coatings; mastic texture coatings, metallic pigmented coatings; swimming pool paints; multi-color paints; quick dry primers; sealers and undercoaters; shellac, sign (graphic arts) coatings; bond breakers; below ground wood preservative coatings.

If anywhere on an exempt coating container, on any sticker or label affixed thereto, or in any sales or advertising literature, any indication is given that such exempt coating may be used or is suitable for use for any purpose other than those specifically provided for in this subsection, then the exemptions provided for in this subsection shall not apply to that coating; rather the limits provided for in subsection c.1. or c.2. shall apply.

c. STANDARDS AND REQUIREMENTS

  1. Except as provided in subsection c.2., a person shall not sell, offer for sale or apply any architectural coating which, at the time of sale or manufacture:

    A. Contains more than 250 grams of volatile organic compounds per liter of coating, excluding water and any colorant added to tint bases; or

    B. Is recommended for use as a bituminous pavement sealer, unless it is an emulsion-type coating.

  2. A person shall not sell, offer for sale or apply any non-flat architectural coating which, at the time of sale or manufacture, has a volatile organic compound content, excluding water and colorant added to tint bases, in excess of the following:

    A. 250 grams of volatile organic compounds per liter of coating if manufactured on or after September 1, 1989.

  3. Containers for all coatings subject to the requirements of subsection c.1., c.2., or c.5. shall display the date of manufacture of the contents or a code indicating the date of manufacture. The manufacturers of such coatings shall file with the Air Pollution Control Officer and the Executive Officer of the California Air Resources Board, an explanation of each code.
  4. Containers for all coatings subject to the requirements of subsection c.1., c.2., or c.5. shall carry a statement of the manufacturer's recommendation regarding thinning of the coating. This recommendation shall not apply to the thinning of architectural coatings with water. The recommendation shall specify that the coating is to be employed without thinning or diluting under normal environmental and application conditions unless any thinning recommended on the label for normal environmental and application conditions does not cause a coating to exceed the applicable standard.
  5. A person shall not sell, offer for sale or apply any architectural specialty coating which, at the time of sale or manufacture, exceeds the following limits (expressed as grams of VOC per liter of coating as applied, excluding water):

  1. In any instance where more than one set of standards set forth in subsection c. may be applied, the most restrictive standards shall apply.
