SCHEDULE 5-GASOLINE DISPENSING EQUIPMENT

Any gasoline equipment, except bulk terminals which are subject to Schedule 4, at a single retail location, including stationary gasoline storage tanks, dispensers, and vapor recovery systems, where required, shall be assessed a permit fee. Beginning in the year 2001, this permit fee shall increase at the rate of ten percent (10%) per year each year for a total of four (4) years. Notwithstanding, in any year subsequent to the 2000 calendar year where the Unreserved Fund Balance for the Air Pollution Control District is in excess of fifteen percent (15%) of the projected appropriations of the subsequent year as of August 1 of that year, the Auditor/Controller shall so certify to the Air Pollution Control Officer or his/her authorized agent whereupon the Air Pollution Control Officer or his/her authorized agent shall grant a deferment of the ten percent (10%) increase of this permit fee for that calendar year. Said deferments shall continue until such time as the Unreserved Fund Balance for the Air Pollution Control District falls below fifteen percent (15%) of the projected appropriations of the subsequent year as of August 1. This permit fee shall be paid according to the following schedule:
