SCHEDULE 9-MISCELLANEOUS SCHEDULE

Any article, machine, equipment or other contrivance which may cause the issuance of air contaminants as defined in Rule 101 of these Rules and Regulations, which is not included in the preceding schedules, shall be assessed a permit fee of $90.00 for the year 2000. Beginning in the year 2001, this permit fee shall increase at the rate of ten percent (10%) per year each year for a total of four (4) years. Notwithstanding, in any year subsequent to the 2000 calendar year where the Unreserved Fund Balance for the Air Pollution Control District is in excess of fifteen percent (15%) of the projected appropriations of the subsequent year as of August 1 of that year, the Auditor/Controller shall so certify to the Air Pollution Control Officer or his/her authorized agent whereupon the Air Pollution Control Officer or his/her authorized agent shall grant a deferment of the ten percent (10%) increase of this permit fee for that calendar year. Said deferments shall continue until such time as the Unreserved Fund Balance for the Air Pollution Control District falls below fifteen percent (15%)of the projected appropriations of the subsequent year as of August 1. Permit fees shall be paid as follows:

First Year: $99.00

Second Year: $108.00

Third Year: $117.00

Fourth Year: $126.00

If the Air Pollution Control Officer determines that the actual costs to the District for inspection, monitoring, evaluation, and administration incurred by a project are substantially different than those paid by the project, the Air Pollution Control Officer may, after documentation of such costs, establish a revised fee for the project. Such determination may be appealed to the Hearing Board in accordance with the Hearing Board Procedures of the Imperial County Air Pollution Control District.
