RULE 301. PERMIT FEE SCHEDULES

Schedule 11 - Public Notification

Pursuant to Rule 300 (Permit Fees), fees shall be determined from the subsequent schedules.  In the event that more than one alternative fee schedule is applicable to a permit, the governing schedule shall be that which results in the higher fee.  Where a group of articles, machines, equipment or other contrivances are included in a single permit, the permit fee shall be based on the total rating of the group. Schedule 10 and 11 fees are in addition to fees from Schedules 1 through 9.



Schedule 1

Fuel Burning Equipment

Any article, machine, equipment or other contrivance in which fuel is burned, with the exception of incinerators which are covered in Schedule 2, shall be assessed a permit fee based upon the design fuel consumption of the article, machine, equipment or other contrivance expressed in thousands of British thermal units (BTUs) per hour using gross heating values of the fuel, in accordance with the following schedule:

Schedule 2

Incinerator

Any article, machine, equipment or other contrivance designed and used primarily to dispose of combustible refuse by wholly consuming the material charged leaving only the ashes or residue shall be assessed a permit fee based on the following schedule of the maximum horizontal inside cross sectional area, in square feet, or other primary combustion chamber:

Schedule 3

Stationary Containers

Any stationary tank, reservoir, or other container (other than gasoline containers) shall be assessed a permit fee based on the following schedule of capacities in gallons or cubic equivalent:

Schedule 4

Internal Combustion Engines

Any stationary piston type internal combustion engine shall be assessed a permit fee based on the following schedule of horsepower:

Schedule 5

Miscellaneous Equipment

Any article, machine, equipment or other contrivance for which a Permit to Operate is required and which is not included in the preceding schedules shall be assessed a permit fee of $453.00. However, if the Air Pollution Control Officer determines that no schedules provided by this Rule fairly represent the District's costs in processing the subject permit application, the Air Pollution Control Officer shall assess a permit fee based on the actual costs incurred by the District in processing the application at a rate of $80.00 per hour of District staff time expended, which shall be rounded to the nearest whole hour. Permit fees assessed under this schedule may be appealed to the District Hearing Board in accordance with Regulation VI - Procedure Before the Hearing Board provisions.


Schedule 6

Gasoline Storage Container

Any stationary tank, reservoir, or other container used for the storage of gasoline shall be assessed an initial permit fee in addition to the application filing fee based on the following schedule of capacities in gallons or cubic equivalent.  Where more than one tank is in use at one site, a single permit to operate for the total gasoline storage capacity shall be issued and the resulting fees shall be determined and based on the resulting total gasoline storage capacity for the facility.

Schedule 7

Solid Waste Disposal Sites

Any place, location, tract of land, area, or premises in use or which has been used for landfill disposal purposes shall be assessed the following fees: A SWAT evaluation fee, as set forth below, and the actual costs for analyses of any sample(s) collected by the District as determined necessary for evaluation.  Sample analyses costs shall be in addition to the SWAT evaluation fee.

Schedule 8

Nonarchitectural Coating and Solvent Applications

Any facility applying at least five (5) gallons per year of all nonarchitectural coatings and solvents shall be assessed a permit fee based on the following schedule of maximum annual coating and solvent usage:

Schedule 9

Gasoline Dispensing Equipment

Any gasoline dispensing facility which is required to install Phase II vapor recovery equipment shall be assessed a permit fee based on the following schedule:

400.00 + $ 46.00 per nozzle

Facilities which are proposing gasoline dispenser modifications with Phase II vapor recovery equipment installed shall be assessed a permit fee of $46.00 per additional nozzle.


Schedule 10

Toxic Air Contaminants

In addition to other fees required, each permit issued for any equipment/operation which may emit or has the potential to emit any toxic air contaminant(s) (TACs), as defined in Rule 1000, shall be assessed a $100.00 fee for each such Permit to Operate.



Schedule 11

Public Notification

In addition to other fees required, projects for which permits are issued following public notice published in newspapers shall pay a public notification fee of $300.00 for the project.
