NOTIFICATION (ATCMs)

This notice is posted in the MDAQMD Rule Book, Regulation X


PLEASE TAKE NOTICE that the requirements of the following Airborne Toxic Control Measures (ATCMs) are enforceable by the MDAQMD as local district rules pursuant to the provisions of California Health & Safety Code §39666.

(a) 17 California Code of Regulations §93102 "Hexavalent Chromium Airborne Toxic Control Measure for Decorative and Hard Chrome Plating and Chromic Acid Anodizing Operations".

(b) 17 California Code of Regulations §93104 "Dioxins Airborne Toxic Control Measure - Medical Waste Incinerators".

(c) 17 California Code of Regulations §93106 "Asbestos Airborne Toxic Control Measure - Asbestos-Containing Serpentine".

(d) 17 California Code of Regulations §93107 "Airborne Toxic Control Measure for Emissions of Toxic Metals from Non-Ferrous Metal Melting".

(e) 17 California Code of Regulations §93108"Ethylene Oxide Airborne Toxic Control Measure - Part 1 - Non-Commercial Sterilizers and Aerators and Commercial Sterilizers Using Less Than 2,000 Pounds of Ethylene Oxide per 12 Consecutive Months" and §93108.5 "Ethylene Oxide Airborne Toxic Control Measure - Part 2 - Commercial Sterilizers and Aerators Using 2,000 Pounds or More of Ethylene Oxide per 12 Consecutive Months".

(f) 17 California Code of Regulations §93109, "Perchlorethylene Airborne Toxic Control Measure - Dry Cleaning Operations".

(g) 17 California Code of Regulations §93110, "Environmental Training Program for Perchlorethylene Dry Cleaning Operators".

PLEASE ALSO TAKE NOTICE that pursuant to the provisions of California Health & Safety Code §39666(d) the MDAQMD has adopted equally effective or more stringent control measures for the following ATCMs as contained in the rules listed below:

(a) MDAQMD Rules 461 - Gasoline Transfer and Dispensing, 462 - Organic Liquid Loading and 463 - Storage of Organic Liquids contain equally effective or more stringent control measures as those found in 17 California Code of Regulations §93101, "Benzene Airborne Toxic Control Measure, Retail Service Stations."

(b) MDAQMD Rule 1503 - Hexavalent Chromium Emissions from Cooling Towers contains equally effective or more stringent control measures as those found in 17 California Code of Regulations §93103 "Regulation for Chromate Treated Cooling Towers."
