RULE 307 - ASBESTOS WASTE DISPOSAL SITE FEES

(A) General Description
(1) This rule requires a fee, pursuant to California Health and Safety Code Section 41512.5, to be charged to asbestos waste disposal sites including, but not limited to, active and inactive landfills, incinerators, and convection or destruction processes, to cover the cost of evaluating plans required by law or by district rules or regulations including, but not limited to, review, inspection and monitoring related thereto.
(B) Asbestos Waste Disposal Site Fees
(1) For each asbestos waste disposal site subject to the National Emissions Standards for Asbestos as set forth in 40 Code of Federal Regulations, Subpart M (and as adopted by reference in District Rule 1000(C)(2)(m)), the owner or operator shall pay the following fees on or before January 1 of each year.
(a) For each facility performing disposal of asbestos-containing material for manufacturing, fabricating, demolition, renovation and/or spraying operations, the owner or operator shall pay, in addition to the fees of Rule 301, a fee of $1,000.00 per year.
(b) For each waste disposal site actively receiving asbestos containing material for disposal which is not covered by subsection (B)(1)(a) above, the owner or operator shall pay, in addition to Rule 308, a fee of $1,000.00 per year.
(c) For each waste disposal site not actively receiving asbestos containing material for disposal but where asbestos-containing waste material was deposited, the owner or operator shall pay, in addition to fees required by Rule 308, a fee of $200.00 per year.
(C) Revocation of Permits
(1) If the asbestos waste disposal site fees are not paid when due, the owner or operator of an asbestos waste disposal site shall thereupon be mailed a second notice. If the overdue fees are not paid within 30 days of the second notice, the "Permits to Operate/Authority to Construct", which are related to the asbestos waste disposal site, will be revoked according to Health and Safety Code Section 42307. Reinstatement of such permits may require compliance with all applicable Rules and Regulations of the District, and payment of all fees specified within this Regulation.
