                                      Rule 1701
                            Employer-Based Trip Reduction

          (A)  General

               (1)  The goals of this rule are to:

                    (a)  Establish 25 percent participation in home-to-work
                         commute  alternative  by employees during the peak
                         period;

                    (b)  Contribute to the attainment  and  maintenance  of
                         the   state   and  national  ambient  air  quality
                         standards within  the  District  by reducing motor
                         vehicle emissions;

                    (c)  Reduce  adverse  environmental impacts  associated
                         with motor vehicle use, such as:

                         (i)  Traffic congestion;

                         (ii) Ambient noise levels;

                         (iii)Non-renewable resource consumption.

               (2)  Applicability:  The requirements  of  this  rule  shall
                    apply to:

                    (a)  All  employers that are located in the portion  of
                         San Bernardino  County  defined  as  "Zone  A," as
                         shown  on  Map 1, and employ 100 or more employees
                         at a single workplace; and,

                    (b)  All employers  that  are located in the portion of
                         San Bernardino County  defined  as  "Zone  B",  as
                         shown  on  Map 1, and employ 200 or more employees
                         at a single workplace.

               (3)  Exemptions:  The  requirements  of  this rule shall not
                    apply to:

                    (a)  Any  employer located within a municipality  which
                         has  adopted   a   Trip   Reduction  Ordinance  as
                         stringent as, or more stringent  than,  this rule,
                         unless the employer in question has been  found to
                         be out of compliance with that Ordinance;

                    (b)  Any   employer  located  in  the  portion  of  San
                         Bernardino County defined as "Zone C", as shown on
                         Map 1;

                    (c)  Any employer  with  100  or  more  employees  at a
                         single workplace within Zone A where fewer than 33
                         employees arrive during the peak period;

                    (d)  Any  employer  with  200  or  more  employees at a
                         single workplace within Zone B where fewer than 50
                         employees arrive during the peak period.

          (B)  Definitions

               For  the  purpose  of  this  rule, the following definitions
               shall apply:

               (1)  "Alternative Work Hours"  - A work schedule that starts
                    and ends the work day outside of the peak period, which
                    may include staggered work  hours, flexible work hours,
                    a  compressed  work  week,  or some  other  alternative
                    schedule.

               (2)  "Carpool" - A motor vehicle occupied  by  two  or  more
                    employees commuting together.

               (3)  "Commute  Alternatives"  - Alternatives to commuting to
                    work in a single occupant  vehicle  such  as  carpools,
                    vanpools,  buspools,  bicycles,  transit,  motorcycles,
                    alternative work hours, telecommuting, or walking.

               (4)  "Compressed Work Week" - A regular weekly or  bi-weekly
                    work  schedule  of  40 hours completed in four days  or
                    less during a single week or 80 hours completed in less
                    than ten days during a two week period.

               (5)  "District Trip Reduction  Coordinator (District TRC)" -
                    A  person  designated  by  the  Air  Pollution  Control
                    Officer  to  administer the District's  Trip  Reduction
                    Program and assist employer Trip Reduction Coordinators
                    with  the implementation  of  Employer  Trip  Reduction
                    Plans.  (See Section (J))

               (6)  "Employee" - Any person hired by an employer to perform
                    work at the workplace, including part-time and seasonal
                    employees  working  20  or  more  hours  per  week, but
                    excluding independent contractors.

               (7)  "Employer"  - Any public or private employer, including
                    governmental  agencies,  which has a permanent place of
                    business in the District.

               (8)  "Employer Trip Reduction Plan" - A document identifying
                    the modes of commute of all  employees at the workplace
                    and  demonstrating a rate of participation  in  commute
                    alternatives that achieves the goals of this rule.

               (9)  "Flexible  Work  Hours"  -  A flexible work schedule in
                    which  an  employee  is  permitted  discretion,  within
                    certain fixed parameters,  as to the hours for starting
                    and completing the work day.

               (10) "Good Cause" - Substantiation that includes, but is not
                    limited  to:  content,  historical  performance,  prior
                    ineffectiveness, and proposed implementation measures.

               (11) "Peak Period" - Refers to  the  travel period from 6:30
                    A.M. through 8:30 A.M. Mondays through  Fridays, except
                    holidays.

               (12) "Single Occupant Vehicle" - A motor vehicle occupied by
                    one    employee   for   commute   purposes,   excluding
                    motorcycles, mopeds, and other two-wheeled vehicles.

               (13) "Staggered  Work  Hours"  -  Fixed  work hours in which
                    groups of employees within a company begin and end work
                    at predetermined intervals to reduce  congestion during
                    the peak period.

               (14) "Trip   Reduction   Coordinator   (TRC)"  -  A   person
                    designated by an employer to implement an Employer Trip
                    Reduction Plan required pursuant to  the  provisions of
                    this rule.

               (15) "Workplace" - A building or group of buildings  located
                    within the same nonattainment area which are within 1/4
                    mile  of  each  other  and are owned or operated by the
                    same   employer  or  by  subsidiaries   of   a   common
                    corporation, business or governmental entity.

               (16) "Zone A" - That portion of San Bernardino County within
                    a line beginning  at:  (1)  the  San  Bernardino  - Los
                    Angeles   County   boundary,  running  east  along  the
                    township line common to Township 7 North and Township 8
                    North; (2) then south  along  the  range line common to
                    Range 1 west and Range 2 West; (3) then  west along the
                    township line common to Township 2 North and Township 3
                    North, as shown in Map 1.

               (17) "Zone B" - That portion of San Bernardino  County  that
                    lies outside Zone A within a line beginning at: (1) the
                    San  Bernardino  -  Riverside  County boundary, running
                    north along the range line common  to  Range 3 East and
                    Range  2  East;  (2) then west along the township  line
                    common to Township  2  North  and Township 3 North; (3)
                    then  north  along  the San Bernardino  -  Los  Angeles
                    County  boundary;  (4)  then  east  along  latitude  35
                    degrees,  10  minutes   north;  (5)  then  south  along
                    longitude 115 degrees, 45 minutes west, as shown in Map
                    1.

               (18) "Zone C" - That portion of  San  Bernardino County that
                    lies north and east of Zone B, as shown in Map 1.

          (C)  Employer Submittal Requirements

               General:  This rule establishes the procedural  requirements
               for  all  affected  employers  to achieve the goals of  this
               rule.

               (1)  Employee Surveys and Analysis

                    (a)  Baseline  Employee  Survey  and  Analysis:   Every
                         employer  shall conduct  and  submit  to  the  Air
                         Pollution  Control  Officer  a  Baseline  Employee
                         Survey and Analysis  no later than sixty (60) days
                         following  notice  of  the   Employee  Survey  and
                         Analysis requirement by the Air  Pollution Control
                         Officer.

                    (b)  Biennial  Employee  Survey  and  Analysis:   Every
                         employer  shall  conduct  and  submit  a  Biennial
                         Employee Survey and Analysis to  the Air Pollution
                         Control   Officer  every  two  years  during   the
                         anniversary month and week following notice of the
                         Employee Survey  and  Analysis  requirement unless
                         otherwise  directed  by the Air Pollution  Control
                         Officer.

               (2)  Employer Trip Reduction Plans/Updates

                    (a)  Employer  Trip Reduction  Plans:   Every  employer
                         shall  prepare   and   submit   an  Employer  Trip
                         Reduction  Plan  to  the  Air  Pollution   Control
                         Officer no later than 180 days following notice of
                         the   Employee   Trip   Reduction  Plan  submittal
                         requirement,   unless   the  employer's   Baseline
                         Employee   Survey   and   Analysis    demonstrates
                         attainment of the goals of this rule.

                    (b)  Employer  Trip  Reduction  Plan  Updates:    Every
                         employer shall prepare and submit an Employer Trip
                         Reduction Plan Update to the Air Pollution Control
                         Officer  every  year  on  the  anniversary  of its
                         Employer Trip Reduction Plan submittal, unless the
                         employer's  latest  Biennial  Employee  Survey and
                         Analysis  demonstrates attainment of the goals  of
                         this rule.

                    (c)  Implementation:      Employer    Trip    Reduction
                         Plans/Updates shall be  implemented  from the date
                         of submission.

               (3)  Maintenance Plans/Updates

                    (a)  Maintenance  Plans:   Every  employer  which   has
                         achieved  the goals of this rule, as documented in
                         its  Baseline  Employee  Survey  and  Analysis  or
                         latest  Biennial  Employee  Survey Analysis, shall
                         prepare  and submit a Maintenance  Plan  no  later
                         than 180 days  after submission of the documenting
                         Employee Survey and Analysis.

                    (b)  Maintenance Plan  Updates:   Every  employer shall
                         prepare  and submit a Maintenance Plan  Update  to
                         the Air Pollution  Control Officer every two years
                         on  the  anniversary  of   its   Maintenance  Plan
                         submittal, unless otherwise directed  by  the  Air
                         Pollution Control Officer.

                    (c)  Implementation:   Maintenance  Plans/Updates shall
                         be implemented from the date of submission.

               (4)  Commute Alternative Information:  Every  employer shall
                    distribute to its employees a description of any action
                    or  combination  of  actions to be carried out  by  the
                    employer  that  are designed  to  promote  the  use  of
                    commute alternatives,  in cooperation with the District
                    TRC.

          (D)  Submission Deadline Extensions

               Upon written request by an employer  documenting good cause,
               the APCO may grant an extension of time, not to exceed sixty
               (60) days, for submittal and/or implementation of a Employer
               Trip Reduction Plan/Update or Maintenance Plan/Update.

          (E)  Employee Surveys

               The  Baseline  Employee  Survey  and  the Biennial  Employee
               Surveys shall include, but not be limited  to, the following
               information compiled during a one week period:

               (1)  The number of employees residing in each  zip  code  by
                    address;

               (2)  The  number  of employees commuting to the workplace by
                    each of the following modes of transportation:

                    (a)  Single occupancy vehicle;

                    (b)  Carpool, including the average number of occupants
                         per vehicle;

                    (c)  Vanpool, including the average number of occupants
                         per vehicle;

                    (d)  Public or Private Transit;

                    (e)  Pedestrian;

                    (f)  Bicycle;

                    (g)  Telecommute; and

                    (h)  all other modes.

               (3)  The number of  employees  participating  in alternative
                    work  hour  program(s),  and  the  percentage  of  such
                    employees using each mode of transportation;

               (4)  The  times  at  which all employees begin and end their
                    work days;

               (5)  The  number  of employees  arriving  at  the  workplace
                    during the peak period each day;

               (6)  The number of  vehicles arriving during the peak period
                    each day;

               (7)  The  number  of  vehicle  miles  travelled  during  the
                    commute trip between  home  and the workplace each day;
                    and,

               (8)  The number of vehicle trips made  to the workplace each
                    day.

          (F)  Employee Survey and Analysis

               A Baseline Employee Survey and Analysis  or  Biennial Survey
               and Analysis shall include the following:

               (1)  Commute Mode Analysis

                    (a)  The number of employees arriving at  the workplace
                         during the peak period in single occupant vehicles
                         on a weekly basis;

                    (b)  The number of employees arriving at the  workplace
                         during   the   peak   period  in  single  occupant
                         vehicles,  represented  as  a  percentage  of  all
                         employees  arriving at the  workplace  during  the
                         peak period,  calculated  for  an average day from
                         weekly totals;

                    (c)  The number of employees arriving  at the workplace
                         during the peak period using commute  alternatives
                         on a weekly basis; and,

                    (d)  The number of employees arriving at the  workplace
                         during the peak period using commute alternatives,
                         represented  as  a  percentage  of  all  employees
                         arriving at the workplace during the peak  period,
                         calculated for an average day from weekly totals.

               (2)  Compliance Determination

                    (a)  If  the percentage calculated in Section (F)(1)(d)
                         of this  rule  is  equal  to  or  greater  than 25
                         percent,   then   the  analysis  shall  include  a
                         statement declaring compliance with this rule; or,

                    (b)  If the percentage calculated  in Sec. (F)(1)(d) of
                         this rule is less than the participation  required
                         in  the  schedule  shown  in  Sec.  G(4), then the
                         analysis  shall  include  an explanation  for  not
                         achieving the goals of this rule.

          (G)  Employer Trip Reduction Plans/Updates

               (1)  General:   Employer  Trip  Reduction   Plans  shall  be
                    designed to achieve the goals of this rule,  and  shall
                    include the following elements.

               (2)  Employer Trip Reduction Coordinator

                    (a)  The  name,  title,  and  telephone  number  of the
                         employer's  TRC,  who  shall  be  responsible  for
                         implementing  the  Employer Trip Reduction Plan at
                         the workplace, and shall  serve  as the employer's
                         liaison to the District; and,

                    (b)  Evidence of participation of the employer's TRC in
                         a training program approved by the  Air  Pollution
                         Control Officer.

               (3)  Present Commute Situation Summary

                    (a)  A  summary of findings of the most recent Employee
                         Survey and Analysis; and,

                    (b)  A description of the employer's transportation and
                         parking  policies  in effect as of the date of the
                         employee survey including, but not limited to, the
                         following:

                         (i)  The  number  of  off-street   parking  spaces
                              provided  for  or available to employees,  on
                              and off the workplace;

                         (ii) The  number  of  off-street   parking  spaces
                              reserved  for  employee  vanpools,   employee
                              carpools,   and   employee   single-occupancy
                              vehicles, and the number of each  occupied on
                              a typical day;

                         (iii)A  description  of  any  transit  or  shuttle
                              service  provided  by  the employer and/or  a
                              third party which is within  one quarter of a
                              mile of the workplace; and,

                         (iv) The amount of subsidy, if any, being provided
                              for  transit passes, carpools,  vanpools,  or
                              other commute alternatives.

               (4)  Commute Alternative Program

                    (a)  A program which identifies how at least 25 percent
                         of the employees  arriving at the workplace during
                         the peak period will  commute to work on a regular
                         basis  by  a  mode  other than  a  single-occupant
                         vehicle.  Compliance  with this requirement may be
                         staged according to the following formula:

                         (i)  5 percent employee participation by the first
                              anniversary date of  Employer  Trip Reduction
                              Plan submission;

                         (ii) 15  percent  employee  participation  by  the
                              second  anniversary  date  of  Employer  Trip
                              Reduction Plan submission; and,

                         (iii)25  percent  employee  participation  by  the
                              third  anniversary  date  of   Employer  Trip
                              Reduction Plan submission.

                    (b)  The  program  shall  identify  the  specific  trip
                         reduction  techniques  to  be  used  by employees,
                         including, but not limited to, the following:

                         (i)  Ridesharing, including carpooling, vanpooling
                              (with   or  without  disabled  access),   and
                              buspooling (or club bus);

                         (ii) Alternative  work  hours,  including flexible
                              work   hours,   staggered   work  hours   and
                              compressed work week schedules;

                         (iii)Use  of  transit, including subsidies  and/or
                              provision  of  shuttle  service  to rail, bus
                              stops, or park-and-ride lots;

                         (iv) Telecommuting, or allowing employees  to work
                              at  home  or  in  a  telecommuting  center  a
                              portion  of  the  work  week  and communicate
                              business   transactions   through  electronic
                              media; and,

                         (v)  Bicycling,  including  provision   that   the
                              workplace  provide bicycle storage facilities
                              and employee lockers and/or showers.

                    (c)  A description of  any  action  or  combination  of
                         actions  involving information dissemination to be
                         carried out  by  the employer that are designed to
                         promote the use of commute alternatives.

               (5)  Implementation  Programs:    If   the   Employer   Trip
                    Reduction Plan includes Implementation Program(s) to be
                    fulfilled  by a third party, including a transportation
                    management organization  or other entity, a letter from
                    each  party  agreeing  to  implement  said  program  or
                    program(s) on behalf of the employer shall be signed by
                    a person authorized to legally commit the entity.

               (6)  De Minimis Exemption:  An employer that can demonstrate
                    the following shall be considered to have qualified for
                    a De Minimis exemption:

                    (a)  In the case of an employer  located  in  Zone A, a
                         work  schedule such that no more than 33 employees
                         report  to or depart from the workplace during the
                         peak period; or,

                    (b)  In the case  of  an  employer located in Zone B, a
                         work schedule such that  no more than 50 employees
                         report to or depart from the  workplace during the
                         peak period.

               (7)  Updates:  An update to an Employer Trip  Reduction Plan
                    shall  be  in  the  form of an addendum to the  initial
                    Employer Trip Reduction  Plan,  incorporating  the most
                    recent data and actions within each section.

          (H)  Employer   Trip   Reduction   Plan/Update   and  Maintenance
               Plan/Update Review

               (1)  Response

                    (a)  The Air Pollution Control Officer shall respond in
                         writing no later than 45 days after  submittal  of
                         any   Employer   Trip   Reduction  Plan/Update  or
                         Maintenance  Plan/Update  with   a   statement  of
                         approval or disapproval.

                         (i)  A statement of disapproval shall  be  sent to
                              the employer by certified mail, and shall  be
                              accompanied by a summary of the reason(s) for
                              disapproval   with   a   list   of  suggested
                              modifications which will allow approval.

                    (b)  If  the  Air  Pollution  Control Officer does  not
                         respond in writing within  45  days of the date of
                         submission   of   any   Employer  Trip   Reduction
                         Plan/Update or Maintenance  Plan/Update,  then the
                         Employer Trip Reduction Plan/Update or Maintenance
                         Plan/Update shall be deemed approved.

               (2)  Review Criteria

                    (a)  Progress towards achieving the goals of this rule;

                    (b)  Content  of  the  Employer Trip Reduction Plan  or
                         Update in comparison  with the requirements stated
                         in Sec. (G); and,

                    (c)  Presence of Implementation Program agreements.

               (3)  Disapproval:  Upon receipt of  written  notification of
                    disapproval, the employer shall either:

                    (a)  Revise the Employer Trip Reduction Plan  or Update
                         to incorporate the modifications suggested  by the
                         Air  Pollution Control Officer and resubmit it  to
                         the  District   within   thirty   (30)   days   of
                         notification of disapproval; or,

                    (b)  Appeal   the   Air   Pollution  Control  Officer's
                         determination to the District Hearing Board.

          (I)  Maintenance Plans/Updates

               (1)  General:  Maintenance Plans shall contain the following
                    information  in  sufficient detail  to  allow  the  Air
                    Pollution Control Officer to evaluate the effectiveness
                    of the Employer Trip  Reduction Plan in maintaining the
                    goals of this rule.

               (2)  Present Commute Situation Summary

                    (a)  A summary of findings  of the most recent Biennial
                         Employee Survey and Analysis;

                    (b)  A description of the employer's transportation and
                         parking  policies in effect  as  of  date  of  the
                         Maintenance Plan;

                    (c)  A   description   of   the   commute   alternative
                         program(s)  made available to employees during the
                         preceding two years;

                    (d)  A description of the methods used to publicize and
                         promote the use of commute alternatives during the
                         preceding two years;

               (3)  Revisions

                    (a)  A discussion  of  progress  made  and/or  problems
                         encountered  in attaining the goals of this  rule,
                         and identification  of revisions to be made to the
                         Employer  Trip  Reduction   Plan  to  enhance  the
                         progress and/or correct the problems encountered;

                    (b)  A discussion of any other changes  to  be  made to
                         the  Employer  Trip Reduction Plan for the ensuing
                         years and the reasons for those changes;

               (4)  Implementation  Programs:    If  the  Maintenance  Plan
                    includes Implementation Program(s) to be implemented by
                    a  third  party, including a transportation  management
                    organization,  or  any other entity, a letter from each
                    party agreeing to implement  said program or program(s)
                    on behalf of the employer shall  be  signed by a person
                    authorized to legally commit the entity.

               (5)  Updates:  An update to a Maintenance Plan  shall  be in
                    the  form  of  an  addendum  to the initial Maintenance
                    Plan, incorporating the most recent  data  and  actions
                    within each section.

          (J)  District Trip Reduction Coordinator
               
               The Air Pollution Control Officer shall designate a District
               Trip Reduction Coordinator.  The District TRC shall have the
               following duties and responsibilities:

               (1)  Administer this rule;

               (2)  Assist  employers  who  are  required  by  this rule to
                    prepare an Employer Trip Reduction Plan;

               (3)  Assist with the coordination of promotional  events  at
                    workplaces  in  which  literature  and  information  on
                    commute alternatives is distributed to employees;

               (4)  Promote   the  use  of  all  available  techniques  for
                    reducing  peak  period  motor  vehicle  use,  including
                    ridesharing,   increased   use   of   public   transit,
                    compressed  work  schedules,  flexible  work schedules,
                    shuttle buses, and telecommuting;

               (5)  Prepare  an  Employer Trip Reduction Plan for  District
                    employees, if the District qualifies; and,

               (6)  Coordinate efforts  with  local  agencies  and employer
                    TRC's  in  the  preparation  of  Employee  Surveys  and
                    Analysis,  training  of  employer TRC's, and monitoring
                    and  evaluating  results  of  Employer  Trip  Reduction
                    Plans/Updates or Maintenance Plans/Updates.

               (7)  Review trip reduction plan  compliance  and prepare and
                    submit  a  summary report to the Air Pollution  Control
                    Officer describing the progress of trip reduction plans
                    throughout the  District in achieving the goals of this
                    rule.

          (K)  Enforcement

               (1)  Any employer who  fails  to  submit  data or a document
                    required by this rule, after a thirty  (30)  day notice
                    to comply, shall be guilty of a misdemeanor.

               (2)  Each  failure  to  supply  data, reports, programs,  or
                    implement a Plan, Program or  Update  required  by this
                    rule,  following  the  Air  Pollution Control Officer's
                    written request for such material  and/or  acts,  shall
                    constitute a separate violation.

               (3)  Every employer who fails to comply with any requirement
                    of  this rule shall have thirty (30) days, after notice
                    of such  failure, to correct the failure, or appeal the
                    matter to the District Hearing Board.

               (4)  Failure to  comply with any of the requirements of this
                    rule shall be  a  violation  and  subject  to  a  civil
                    penalty  as authorized under 42 United States Code 7401
                    Section 113(d) and/or California Health and Safety Code
                    Section 42400  et.seq.  until  the failure to comply is
                    corrected.

          (L)  Records Maintenance

               Records of data from Employee Surveys and Analysis, Employer
               Trip Reduction Plans/Updates, and Maintenance  Plans/Updates
               shall be maintained on file for a period to two  (2)  years,
               and  within  this  period, upon request by the Air Pollution
               Control Officer, shall  be made available to the Air Quality
               Management District 1.
