RULE 390 - Asbestos Demolition and Renovation Projects
Any owner or operator of a demolition or renovation project which
is subject to 40 CFR-61, Subpart M (NESHAPS) for asbestos and is
required to submit a written notification of the
demolition/renovation to the District shall pay to the District the
following fee:
DEMOLITIONS
1. Demolitions involving less than 260 lineal ft,
160 ft2, or 35 ft3 RACM (Regulated Asbestos
Containing Material) NO FEE
(notification required)
2. Demolitions involving 160 ft2 but less than 5000 ft2;
260 lineal ft but less than 1000 lineal ft;
or more than 35 ft3 RACM $ 25
3. Demolitions involving 5000 ft2 or more;
1000 lineal ft or more of RACM $100
4. Each revision notification of demolition of 2 and 3
above $ 10
RENOVATIONS
1. Renovations involving the removal or
stripping of less than 260 lineal ft,
160 ft2, or 35 ft3 RACM NO FEE
(no notification required)
2. Renovations involving the removal
or stripping of 160 ft2 but less than 5000 ft2;
260 lineal ft but less than 1000 lineal ft;
or more than 35 ft3 of RACM $ 25
3. Renovations involving the removal
or stripping of 5000 ft2 or more; 1000 lineal ft
or more of RACM $100
4. Each revision notification of renovation
of 2 and 3 above $ 10
If in the course of a demolition or renovation project it is
determined that the project belonged to a higher fee category than
was initially determined, the owner or operator shall pay the
balance of the fee for the higher category.
The appropriate fees listed above shall accompany the notification form. If the fees do not accompany the project notification form, the notification will be considered as a failure to notify, which could subject the owner or operator to significant penalties.
