100 GENERAL

101 - PURPOSE: To reduce air pollution from non-agricultural open outdoor fires.

110 - EXEMPTIONS: Section 300 of this rule does not limit the authority granted under other provisions of law to any public officer to set or permit a fire when such fire is, in his or her opinion, necessary for the purposes in Section 41801 of the California Health and Safety Code.


200 DEFINITIONS

201 - EXPLOSIVE: Any substance or article, including a device, which is designed to function by explosion(i.e., an extremely rapid release of gas and heat) or which, by chemical reaction within itself, is able to function in a similar manner even if not designed to function by explosion.

202 - FLUE: Any duct or passage for air, gases, or the like, such as a stack or chimney.

203 - MILITARY MUNITIONS: All ammunition products and components produced for national defense and security. Military munitions include gaseous, liquid, and solid propellants, explosives, pyrotechnics, chemical and riot control agents, smokes, and incendiaries used by Department of Defense components, including bulk explosives and chemical warfare agents, chemical munitions, rockets, guided and ballistic.

204 - OPEN OUTDOOR FIRE: Any combustion of material of any type outdoors in the open, where the products of combustion are not directed through a flue.

205 - ORGANIC WASTE: Residential yard clippings including, but not limited to grass clippings, tree or shrub clippings, wood, plant bedding materials, and wooden construction materials.

206 - OXIDIZER: Any material that may, generally by yielding oxygen, cause or enhance the combustion of other materials.

207 - PEP WASTE: Any substance being disposed of consisting of any of the following:

208 - PROPELLANT: A substance that is used to propel a projectile, rocket or related device.

209 - PYROTECHNIC: An explosive device, or a combustible substance used in an explosive device.

210 - REFUSE: Including but not limited to rubbish, garbage, food stuffs, putrescible waste, paper, plastic, cardboard, and similar waste materials.


300 STANDARDS

301 - NO-BURN DAY PROHIBITION: A person shall not burn, allow to be burned, or maintain any open outdoor fire for the purpose of burning household refuse or organic waste on an agricultural no-burn day. For the purposes of this Section, an agricultural no-burn day will be as designated by the California Air Resource Board, the County Agriculture Commissioner, or the District and notification of each agricultural no-burn day designation will occur through County Fire Department dispatch.

302 - PROHIBITION OF OPEN BURNING: A person shall not burn, allow to be burned, or maintain any open outdoor fire for the purpose of burning refuse or organic waste at any time;

303 - PROHIBITIONS FOR PEP WASTE: Until December 31, 2001 open burning of PEP waste is allowed with no restrictions.

304 - POLLUTANT STANDARDS INDEX (PSI) PROHIBITIONS: No burning of PEP materials shall be conducted during periods where the predicted PSI for ozone in the Sacramento non-attainment area is greater than 100.


400 ADMINISTRATIVE REQUIREMENTS

401 - CONSULTATION: Prior to conducting an open outdoor fire for the open burning of PEP waste, the person or entity conducting the fire shall give verbal notification to the Air Pollution Control Officer.

402 - TREATMENT PERMITS: Any alternative to the open burning of PEP waste shall be subject to Rule 201 GENERAL PERMIT REQUIREMENT.
