VENTURA COUNTY AIR POLLUTION CONTROL DISTRICT

RULE 55 - EXEMPTIONS FROM EMISSION STANDARDS

The following operations, equipment or emissions are exempt from emission standards and prohibitions:

A. Exempt From Rule 50 (Opacity)

  1. Smoke from fires set in accordance with the requirements of Rule 56 (Open Fires).

  2. Dust generated by the cultivation of land, harvesting of crops or by livestock.

  3. The use of an orchard heater which does not produce unconsumed solid carbonaceous matter at a rate in excess of one (1) gram per minute.

  4. Source emissions when the presence of uncombined water is the only reason for the failure of an emission to meet the limitations of Rule 50. The burden of proof which establishes the application of Rule 50 shall be upon the person seeking to come within its provisions.

B. Exempt from Rule 51 (Nuisance) - as per California Health and Safety Code Section 41705.

  1. Odors emanating from agricultural operations in the growing of crops or raising of fowl or animals.

C. Exempt from all applicable emission prohibitions, except Rules 51 (Nuisance), 72 (NSPS) and 73 (NESHAPS).

  1. Smoke generators approved by the Air Pollution Control District which are intentionally operated for purposes of training observers in observing the shade or opacity of emissions.

  2. Short duration, infrequently operated sources engaged in experimental or research operations not exceeding an aggregate of two hours per month.
