Rule 74.17.1 Municipal Solid Waste Landfills
(Adopted 3/10/98)

  1. Applicability
    1. The provisions of this Rule shall apply to all municipal solid waste (MSW) landfills meeting both of the following conditions:
      1. Construction, reconstruction, or modification was commenced before May 30, 1991; and
      2. The MSW landfill has accepted waste at any time since November 8, 1987 or has additional design capacity available for future waste deposition.
    2. The provisions of this Rule shall apply to any solid waste disposal site exempted under Subsections F.3 or F.4 of Rule 74.17.
  2. Requirements - Gas Collection and Control System
    1. Each owner or operator of a MSW landfill that has either:
      1. a. A design capacity equal to or greater than 2.5 million megagrams or 2.5 million cubic meters, and a NMOC emission rate of 50 megagrams per year or more, as calculated pursuant to 40 CFR 60.754; or
      2. b. More than 500,000 tons of degradable waste in place shall submit a design plan and shall install a gas collection and control system meeting the conditions provided in 40 CFR 60.752, and as required in Subsections B.2 through B.4 of this Rule.
    2. Each owner or operator of a MSW landfill required to install a gas collection system under this Section shall meet all of the following additional requirements:
      1. Operate the collection system such that gas is collected from each area, cell, or group of cells in the MSW landfill in which the initial solid waste has been in place for a period of two years or more if active. The requirements of 40 CFR 60.752(b)(2)(ii)(A)(2)(i), 40 CFR 60.753(a)(1), and 40 CFR 755(b)(1) concerning the timing of operation of the gas collection system shall not apply to MSW landfills subject to this Rule.
      2. Route all collected gas to an active collection system that complies with the requirements of 40 CFR 60.752(b)(2)(ii)(A). The requirements of 40 CFR 60.752(b)(2)(ii)(B) concerning passive collection systems shall not apply to MSW landfills subject to this Rule.
    3. Each owner or operator of a MSW landfill required to install a control system under this Section shall meet all of the following additional requirements:
      1. a. Route all collected gas to a control system that complies with the requirements of 40 CFR 60.752(b)(2)(iii)(B), or (C). The requirements of 40 CFR 60.752(b)(2)(iii)(A) concerning the use of open flares shall not apply to MSW landfills subject to this Rule.
      2. b. Flares used as control devices shall meet all of the following additional requirements:
      3. 1) Flares shall be of the enclosed ground type with automatic dampers, an automatic shutdown device, a flame arrester and continuous recording temperature sensors. During restart or startup there shall be a sufficient flow of propane or commercial natural gas to the pilot flame to ensure immediate ignition when in contact with landfill gasses.
      4. 2) NOx emissions shall not exceed 0.06 pounds per million BTUs of heat input.
      5. 3) CO emissions shall not exceed 0.20 pounds per million BTUs of heat input.
      6. The owner shall demonstrate that each flare meets the NOx and CO requirements of this Subsection using the source testing procedures in Section F of this Rule. Source testing shall be performed when the device begins operation. Flares shall be source tested to demonstrate continuing compliance every two years thereafter. All other control devices shall be source tested annually to demonstrate continuing compliance.
    4. Each owner or operator of a MSW landfill required to install a gas collection and control system under this Section shall meet the operational standards of 40 CFR 60.753, the test methods and procedures of 40 CFR 60.754, the compliance provisions in 40 CFR 60.755, and the monitoring provisions in 40 CFR 60.756, except as provided in Subsection G.3. of this Rule. The APCO may approve alternatives in the design plan as provided in Subsection G.3 of this Rule.
  3. Exemptions

  4. Any municipal solid waste landfill that is subject to the requirements of the New Source Performance Standard Subpart WWW - Standards of Performance for Municipal Solid Waste Landfills (40 CFR 60.750) is exempt from the requirements of this Rule.
  5. Recordkeeping Requirements

  6. The owner of operator of each MSW landfill shall satisfy the recordkeeping requirements of 40 CFR 60.758, as applicable, except that the APCO may approve alternative recordkeeping provisions as provided in Subsection G.3 of this Rule. Any records required to be submitted pursuant to 40 CFR 60.758 shall be submitted to the APCO.
  7. Reporting Requirements
    1. The owner or operator of each MSW landfill shall submit an initial design capacity report and amended design capacity report as specified in the standards in 40 CFR 60.752. Any density conversions shall be documented and submitted with the report.
    2. The owner or operator of each MSW landfill shall meet the reporting requirements of 40 CFR 60.757, as applicable, except that the APCO may approve alternatives in the design plan as provided in Subsection G.3 of this Rule. Any reports required to be submitted pursuant to 40 CFR 60.757 shall be submitted to the APCO.
  8. Test Methods
    1. The NOx and CO emissions from flares used as control devices shall be determined using:
      1. EPA Method 7E for NOx.
      2. EPA Method 10 for CO.
      3. ASTM D1826-77 for the gross (higher) calorific value (GCV) of landfill gas.
      4. EPA Method 3A for Oxygen Concentration.
      5. The F Factor method contained in 40 CFR part 60.45(f)(5) and 40 CFR 60, .46(f) Appendix A, Method 19.
  9. Collection and Control System Design Plan
    1. The owner or operator of a MSW landfill shall submit a site-specific collection and control system design plan to the APCO as required in Section B of this Rule, and shall be subject to all applicable fees in Rule 45.4, Municipal Solid Waste Landfill Plan Fees.
    2. The design plan shall provide for the control of collected MSW landfill emissions through the use of a collection and control system meeting the collection and control system requirements of Section B of this Rule.
    3. The APCO shall review and either approve or disapprove the plan, or request that additional information be submitted. The design plan shall either conform with specifications for active collection systems in 40 CFR 60.759 or include a demonstration to the APCO's satisfaction of the sufficiency of the alternative provisions to 40 CFR 60.759. The design plan shall include any alternatives as specified in 40 CFR 60.752(b)(2)(i)(B).
  10. Compliance Schedule

  11. The owner or operator of a MSW landfill subject to this Rule shall implement the following compliance schedule as expeditiously as practicable, but no later than the compliance times specified below.
    1. The design capacity and the NMOC emission reports required pursuant to 40 CFR 60.752 and 40 CFR 60.754 shall be submitted by June 8, 1998.
    2. The site-specific collection and control system design plan required by Section G of this Rule shall be submitted by March 10, 1999, or within one year after meeting either condition in Subsection B.1.
    3. The planning, awarding of contracts, installation, and startup of the collection and control system required pursuant to Section B of this Rule shall be accomplished by September 10, 2001, or within 30 months after meeting either condition in Subsection B.1.
    4. The initial performance test of the collection and control system shall be accomplished within 6 months of collection and control system startup, and the test results submitted within 60 days after the performance test is completed. The owner or operator of a MSW landfill subject to this Rule shall provide the APCO at least 30 days prior notice of any performance test to afford the APCO the opportunity to have an observer present.
  12. Definitions

  13. Except as noted below, all definitions applicable to this Rule shall be given in 40 CFR 60.751 (Definitions).
    1. "Administrator": Means the Air Pollution Control Officer (APCO) of the Ventura County Air Pollution Control District, except that the APCO shall not be empowered to approve:
      1. alternative or equivalent test methods, alternative standards; or
      2. work practices unless included in the site-specific design plan as specified in 40 CFR 60.752(b)(2)(i)(B).
    2. "Design plan or plan": means the site-specific design plan for the gas collection and control system submitted under Section G of this Rule.
