Between December 2008 and May 2009, O’Reilly Automotive, Inc. sold O’Reilly Carb & Choke Cleaner product that contained VOCs in excess of the 45% limit for Carburetor Cleaners in California. The product was not intended for sale in California, however, approximately 3.4 tons of excess emissions resulted from the violations. Since both O’Reilly and Technical Chemical Company, their manufacturer, were culpable for the violation, the case split between the two parties. The O’Reilly’s portion of the case was settled on June 15, 2012 for $31,500.
