Sons of DeRose Trucking LLC will pay $6,500.00 in penalties for violating air quality regulations: $4,875.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,625.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.  This settlement was reached in February, 2017.

An investigation by the Air Resources Board (ARB) showed that Sons of DeRose Trucking LLC failed to bring one of their trucks and eight of their Transport Refrigeration Units (TRU) into compliance with the applicable in-use performance standards.  ARB documented violations as they related to the Truck and Bus (TB) Regulation and the TRU Airborne Toxic Control Measure.  To settle the case, Sons of DeRose Trucking LLC agreed to the $6,500.00 penalty and to comply with TB, TRU, and other ARB programs.
