The California Air Resources Board (CARB) invites you to participate in a final public workshop to discuss updates to CARBís enforcement policy. Our current penalty policy was adopted in 2011. CARB is updating its penalty policy partly to respond to AB 1685 (2016) which, among other things, increases the maximum penalties for mobile source violations and clarifies how those penalties can be applied. In addition to updating the current penalty policy to address AB1685, we are taking this opportunity to develop a more comprehensive enforcement policy. Staff will also distribute hard copies of the draft policy and presentation slides at the workshop. Background The current penalty policy was developed in 2011 to comply with SB 1402 (2010) which required that CARB articulate the basis for determining penalties for violations discovered through enforcement actions. CARB is updating its current penalty policy partly to respond to AB 1685 (2016), which better aligns Californiaís maximum mobile source penalties with federal penalties. AB 1685 increases the maximum penalty for mobile source violations, and clarifies CARBís ability to enforce multiple violations for each applicable mobile source. CARB is soliciting public input on potential impacts of AB 1685 and on developing a more comprehensive enforcement policy overall.
