fuels -- OAL disapproval of CaRFG3 Ammendments

The State of California Office of Administrative Law (OAL) has disapproved the regulatory action regarding the 2007 amendments to the Phase 3 California Reformulated Gasoline regulations. OAL’s main basis for their disapproval centered around Table 12 of the “California Procedures for Evaluating Alternative Specifications for Phase 3 Reformulated Gasoline Using the California Predictive Model.” Table 12 contains the means and standard deviations of the fuel properties in the model. OAL determined that Table 12 was updated in response to a comment as part of the first 15 day package and not released for public comment after it had been updated. This was the main basis for the disapproval. The rest of the issues in their disapproval are considered minor. Pursuant to Government Code section 11349.4, the adopting agency may resubmit the regulation(s) to OAL within 120 calendar days of receipt of the written decision detailing the reason(s) for disapproval of the regulatory filing. ARB staff are currently in the process of creating a second 15 day package so that changes to the “California Procedures for Evaluating Alternative Specifications for Phase 3 Reformulated Gasoline Using the California Predictive Model” may be reviewed by the public.
