ordiesel -- Off-road Diesel Vehicle Regulation - Double Retrofit Credit Deadline Extended

On January 22, 2009, the Air Resources Board (ARB) amended the in-use off-road diesel vehicle regulation, extending the deadline to receive double credit for verified exhaust retrofits from March 1, 2009, to January 1, 2010. The extension gives fleets 10 additional months to receive double credit for installing retrofits. Additionally, if the installation of retrofits is delayed due to the manufacturer or installer, fleets may still receive double credit if the retrofit was ordered prior to September 1, 2009, (four months prior to the January 1, 2010, deadline). The DOORS system will conditionally reflect double credit for all retrofits installed before January 1, 2010, pending final approval from the Office of Administrative Law, which we expect later this year. In addition, ARB amended the language of the regulation, clarifying the delay in turnover requirements for Tier 1 vehicles, the reporting requirements for retrofits, and the disclosure record-keeping requirements. The amendments also removed the penalty for small fleets which become larger fleets and then subsequently reduce their horsepower and become small again. The reporting requirements in 2009 for all fleets, and the emissions requirements in 2010 for large fleets, have not changed.
