tru -- Model Year 2003 Engines Must Comply by December 31, 2010

Model year 2003 TRU engine owners should make compliance
decisions now and place orders for compliance technology now to
ensure compliance by December 31, 2010. 

The California Air Resources Board’s (ARB) Transport
Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM)
currently requires model year (MY) 2003 engines to meet the
Ultra-Low-Emission TRU (ULETRU) in-use standards by December 31,
2010. The ULETRU standard can be met by retrofitting with a Level
3 verified diesel emissions control system (VDECS) that reduces
diesel particulate matter by at least 85 percent.

ARB has proposed amendments to the TRU ATCM, which will be
considered by the Board on November 18, 2010.  One of the
proposed amendments affects MY 2003 TRU engines and would allow
them to comply with the in-use standard requirements by meeting
either the ULETRU in-use standard, as described above, or as an
option, by meeting the less stringent LETRU in-use standard.  The
LETRU in-use standard can be met by retrofitting with a Level 2
VDECS that reduces diesel PM by at least 50 percent.  The
proposed optional LETRU compliance path is being offered due to
limited availability of Level 3 control systems.

Some MY 2003 TRU owners have expressed uncertainty about the need
to comply because of the pending Board decision.  To clarify, the
in-use requirements for MY 2003 TRU engines were approved in
February 2004 and became effective December 2004.  There will be
no enforcement delay or compliance extension for MY 2003 engines.
 MY 2003 TRU engines must meet the in-use performance standard by
December 31, 2010.  ARB will enforce the in-use standards for MY
2003 engines starting early 2011 and will accept either ULETRU
(Level 3 retrofit) or LETRU (Level 2 retrofit).  Another
compliance option would be to replace the MY 2003 engine with a
2004 or later MY engine. However, if this engine replacement
option is chosen, the ULETRU emission standards would have to be
met by December 31st of the seventh year after the replacement
engine’s model year (or effective model year in the case of a
prior-tier engine).  As TRU Advisory 10-19 indicates, MY 2003
owners should make compliance decisions now and place orders for
compliance technology now to ensure compliance by December 31,
2010.
