On March 13, 2014, the Air Resources Board (ARB) Executive Officer signed Executive Order (EO) G-70-216, extending the effective date for the installation of certified Phase I enhanced vapor recovery (EVR) systems at select existing aboveground storage tank (AST) facilities due to the finding that compatible certified systems for certain AST configurations may not be commercially available. Existing ASTs are required to comply with Phase I EVR requirements by July 1, 2014 (unless otherwise noted in ARB’s Regulatory Advisory, issued February 28, 2014). The currently certified Phase I EVR systems require ASTs to meet the following configuration requirements: that gasoline must be received through a top-fill opening (direct or remote fill); the diameter of the product tank opening, or bung, must be at least four inches; a minimum of three bungs are required to accommodate the various Phase I EVR components; or the tank must be equipped with an adequately sized bung for an emergency vent. Once a Phase I system is certified that overcomes the deficiencies of the currently certified system, these ASTs will have four years from the date of certification to comply as specified by regulations.
