compwood -- Important Reminder - Composite Wood Products ATCM

Over the past two years, staff of the Air Resources Board (ARB/Board) released preliminary drafts and held workshops regarding proposed amendments to the airborne toxic control measure (ATCM) to reduce formaldehyde emissions from composite wood products. We want to emphasize that at this stage in our process, our proposed amendments are draft and are not finalized. Any proposed amendments will be not be legally effective until considered and approved by our Board and subsequent review and approval by the California Office of Administrative Law. This is not expected to happen until sometime in 2015. It is important that anyone subject to the requirements in the ATCM continue to follow the current adopted regulatory requirements that can be found at http://www.arb.ca.gov/regact/2007/compwood07/fro-final.pdf. As you may also be aware, in 2013 the U.S. Environmental Protection Agency (EPA) proposed a federal regulation of composite wood products. We are in regular communication with EPA staff and understand that EPA hopes to finalize their regulation by the end of 2014. The EPA regulation will take effect one year after it is finalized. ARB staff is working with EPA staff in an attempt to harmonize ARB’s ATCM and the federal regulation to the extent possible, to minimize differences between the two regulations. ARB staff will likely wait until EPA’s regulation is finalized before we present proposed amendments to our Board for their consideration and approval.
