The California Air Resources Board’s draft Supplemental Environmental Projects (SEP) Policy now available, additional workshop has been scheduled in Fresno . Draft Supplemental Environmental Projects Policy: https://www.arb.ca.gov/enf/sep/final-draft-sep-policy-101716.pdf The California Air Resources Board (ARB) invites you to participate in the second series of public workshops relating to the update of ARB’s Supplemental Environmental Projects (SEP) Policy. A SEP is an environmentally beneficial project that a person subject to an enforcement action voluntarily agrees to undertake in settlement of the action and to offset a portion of a civil penalty. In 2015, Assembly Bill 1071 was passed which requires all boards, departments, and offices within the California Environmental Protection Agency (CalEPA) to develop a policy on SEPs that benefits disadvantaged communities. These workshops will introduce ARB’s revised draft SEP Policy, and provide an opportunity to comment on the selection, development, and implementation of SEPs under the new SEP Policy. The same information will be presented at each workshop. The workshops will be held at the following locations and times: Date: October 24, 2016 Time: 2:00 p.m. – 4:00 p.m. Location: Elihu M. Harris State Office Building 1515 Clay Street, Room 1 Oakland, California 94612 Directions: https://www.cdph.ca.gov/programs/hai/Documents/TravelingtoOakland.pdf Date: October 25, 2016 Time: 4:00 p.m. – 6:00 p.m. Location: Kern County Public Services Building 2700 M Street, #100, First Floor Conference Room Bakersfield, California 93301 Directions: https://goo.gl/maps/moMCXMja57H2 Date: October 26, 2016 Time: 5:00 p.m. – 7:00 p.m. Location: Comite Civico del Valle 235 Main Street Brawley, California 92227 Directions: https: //goo.gl/maps/ReBo2hQppRr Date: October 27, 2016 Time: 6:00 p.m. – 8:00 p.m. Location: Auditorium of the California Air Resources Board 9530 Telstar Avenue El Monte, California 91731 Directions: https: //goo.gl/maps/W n8sK7E1hLP2 Date: November 2, 2016 Time: 5:30 p.m. – 7:30 p.m. Location: Community Media Access Collaborative 1555 Van Ness Avenue Fresno, California 93721 Directions: https: //goo.gl/maps/MvQFUk8cQD62 Background State Law allows companies and individuals who have violated air quality regulations to pay part of a penalty to support a SEP. In 2015, ARB assessed more than $10 million in penalties and diverted more than $1.5 million of these funds to support SEPs. Assembly Bill 1071 (Atkins) was adopted in 2015, and requires each board within the CalEPA to establish a policy on SEPs that benefits disadvantaged communities, and allows up to 50 percent of an enforcement penalty to be devoted to a SEP. The policy must be developed through a public process, and each board is required to develop an annual list of SEPs that may be selected for implementation. The policy is required to consider the relationship between the location of the violation and the location of the proposed SEP.
