BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. Six local air districts are offering financial incentives to owners of trucks used in goods movement to upgrade to cleaner technologies through truck replacement or engine repower projects. These funds are available for eligible trucks operating primarily in the four high priority trade corridors in the Bay Area, Central Valley, Los Angeles/Inland Empire, and San Diego/Border corridors. Incentives for truck electrification infrastructure projects will also be offered. The local agencies will be accepting applications beginning August 26, 2013, for a limited time. In addition, owners of fleets of 40 or fewer trucks may be eligible for loan assistance, without the Prop. 1B grant limitations regarding goods movement and operation in the trade corridors. NOTICE: The Air Resources Board (ARB or the Board) invites you to participate in a public workshop on September 17, 2013, in Diamond Bar, California, to discuss updates to the Zero Emission Bus (ZBus) regulation and to explore the status of, and future developments to, ZBus technology and related systems. At this workshop, ARB will establish the continued need for ZBus technology development. ZBus manufacturers and technology providers will discuss the current state of zero-emission bus technology and where they anticipate this technology will be in the near, and medium term future. In addition, transit agencies will share their experiences with procuring zero emission buses, operating within urban fleets, and maintenance challenges and opportunities. Staff plans to hold additional workshops following this workshop to explore regulatory options and to take comments on draft amendments prior to taking the regulatory package to the Board in May 2014. BACKGROUND: The Zero Emission Bus regulation, first adopted in 2000, applies transit agencies with 200 or more urban busses. The regulation requires 15 percent of new buses purchases must be zero emission. The regulation was amended in 2006, the Board pushed off the purchase requirement to 2010, but gave the executive officer (EO) the ability to suspend the requirement so long as cost, durability and performance remained issues. The EO has suspended the purchase requirement indefinitely since 2010. The board will be considering changes or amendments to regulation which may affect the 15 percent purchase requirement.
