This schedule provides an overview of the current plans for regulatory and implementation activities during 2011, including public workshops, planned discussion topics, and expected release of regulatory changes. The final resolution has been posted, and can be found on the cap-and-trade rulemaking web site at http://www.arb.ca.gov/regact/2010/capandtrade10/capandtrade10.htm. The resolution is dated December 16, 2010, based on the Board meeting, and has been updated to reflect the changes directed by the Board members when they approved the resolution that day. Also posted on the web site are Attachment B to the resolution and Appendix 1 to Attachment B. The Board members did not direct any change to the Attachment or Appendix, so these documents are unchanged from those presented to the Board on December 16, 2010. DATE: Friday, July 15, 2011 TIME: 9 am to 3 pm LOCATION: Byron Sher Auditorium, 2nd Floor, Cal/EPA HQ Building, 1001 “I” Street, Sacramento Prior to the workshop, ARB will make the draft changes available in discussion drafts of the cap-and-trade and mandatory reporting regulations that outline changes based on Board direction from the December 2010 consideration of these rules. A separate listserv notice will be sent when these drafts are available. In December 2010, the Board directed ARB staff to finalize a cap-and-trade regulation, and corresponding revisions to the mandatory GHG reporting regulation. The cap-and-trade program covers major sources of GHG emissions in the State such as refineries, power plants, industrial facilities, and transportation fuels. The endorsed regulation includes an enforceable emissions cap that will decline over time. The State will distribute allowances, which are tradable permits, equal to the emissions allowed under the cap. Sources under the cap will need to surrender allowances and offsets equal to their emissions at the end of each compliance period. The discussion draft will propose to initiate the cap-and-trade program in 2012, but start the requirements for compliance in 2013. Under this proposal, the program would have a 2-year first compliance period rather than the 3-year compliance period originally envisioned. No allowances would be issued for 2012, and there would be no compliance obligation for 2012 emissions. More details on the elements of the program, including auction timing, will be in the forthcoming discussion draft. It is particularly appropriate where complex systems are involved, where the effects of an agency’s decisions and actions play out over an extended period of time, and where the agency must meet multiple objectives – as in the case of the proposed regulation. Adaptive management is consistent with ARB’s long-standing approach to program implementation which incorporates on-going evaluation of how programs and regulations are implemented on the ground, regular updates to the Board, and adjustments to program implementation and regulatory requirements, as necessary. The Board will consider for approval the Proposed Adaptive Management Plan prior to the Board taking final action on the proposed regulation. At the December 2010 hearing, the Board directed ARB staff to finalize a cap-and-trade regulation. The cap-and-trade program covers major sources of GHG emissions in the State such as refineries, power plants, industrial facilities, and transportation fuels. The regulation includes an enforceable emissions cap that will decline over time. The State will distribute allowances, which are tradable permits, equal to the emissions allowed under the cap. Sources under the cap will need to surrender allowances and offsets equal to their emissions at the end of each compliance period. If adopted, the program will become effective in 2012, with emissions compliance requirements starting in 2013. Two 15-day notices of regulatory changes were issued during the cap-and-trade rulemaking. The Final Cap-and-Trade regulation order, now available for download, incorporates these changes to the regulation considered by the Board in December 2010. The four final compliance offset protocols identify the project types and quantification methods to generate ARB offsets eligible for use under the cap-and-trade regulation. The regulation is effective January 1, 2012. The version approved by OAL removed several ‘reserved’ sections (that is, sections that referenced future regulatory elements that have not yet been approved) in the regulation to conform to rulemaking requirements under the Administrative Procedure Act. The removal of ‘reserved’ sections does not reflect policy decisions on whether those areas will or will not be addressed in future rulemakings. Staff will continue to engage with stakeholders on issues identified in Resolutions 10-42 and 11-32.
