Date: Mon, 9 Jan 2012 14:04:38 -0800 Subject: arbcombo -- Online Registration Now Available for Californias Cap-and-Trade Program From: corlando@arb.ca.gov NOTE *** Covered entities must register by January 31, 2012 ***. The California Air Resources Board (ARB) is providing an online registration form for covered entities to register for the cap-and-trade program as required by the California Cap on Greenhouse Gas Emissions and Market-Based Compliance Regulation. Under the regulation, entities that meet the requirements to be designated as “covered entities” must register for the cap-and-trade program by January 31, 2012. The information provided by registrants is needed to initiate the regulatory relationship between ARB and entities subject to the cap-and-trade regulation. This information will also be used to communicate important regulatory and implementation information with the covered entities. Voluntary market participants may also use the form to register for the program, but they are not subject to the January 31, 2012 deadline. The form and supporting documentation may be accessed from the ARB website at: http://www.arb.ca.gov/cc/capandtrade/registration/registration.htm Guidance to help facilities determine if they are designated as a “covered entity” is available at: http://www.arb.ca.gov/cc/capandtrade/registration/registration-guidance.pdf Additional information about the cap-and-trade program and regulation can be accessed from our website at: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm If you have questions, please contact David Kennedy at dkennedy@arb.ca.gov or (916) 322-3935. *Update on Compliance Instrument Tracking System Service* ARB staff is also developing the Compliance Instrument Tracking System Service (CITSS) to support the cap-and-trade regulation. CITSS will provide accounts for market participants to hold and retire compliance instruments (allowances and ARB offsets), and to participate in transactions of compliance instruments with other account holders. Registration in the CITSS will be available by spring of 2012. Staff will provide training on the system and details about any requirements for additional required or updated information (beyond that provided on the form linked to this notice) as part of the CITSS registration process. For general questions regarding the cap-and-trade program, please call the cap-and-trade hotline number at (916) 322-2037. The guidance document discusses information regarding opting into the program as well as suggested dates for submitting documentation. To download a copy of the Cap-and-Trade Program opt-in guidance document, go to: http://www.arb.ca.gov/cc/capandtrade/optinguidance.pdf To download a copy of the Cap-and-Trade Program Opt-In Request Form, go to: http://www.arb.ca.gov/cc/capandtrade/optinform.docx An opt-in covered entity is an entity that voluntarily elects to be covered under the Cap-and-Trade Program and surrender allowances for each metric ton of greenhouse gas it emits. Opt-in covered entities may be eligible to receive free allowances based on the same criteria as covered entities, and can elect to opt out of the program at the end of a compliance period if its greenhouse gas emissions remain under the inclusion threshold. In order to become an opt-in covered entity, the entity must be in one of the sectors covered under the Cap-and-Trade Program, but must not already be required to comply with the regulation because it emits less than 25,000 MTCO2e annually. In order for an entity to voluntarily participate in the Cap-and-Trade Program as an opt-in covered entity, we request that you submit the Opt-in Request Form, distributed through the link above, to the Air Resources Board’s Executive Officer for approval by the dates given in the guidance document for opt-in covered entities. The guidance document for opt-in covered entities outlines the information ARB requests in order to opt in to the program. Subarticles 13 and 14 of the regulation describe the compliance offset program and the approval of Early Action Offset Credits. Included in these sections is a requirement for third-party verification of all GHG emission reductions and GHG removal enhancements before any ARB offset credits may be issued. Only ARB accredited offset verifiers and verification bodies may provide offset verification services under the compliance offset program. Accordingly, ARB has established a program to accredit offset verifiers and verification bodies that meet the regulation’s requirements. To assist ARB in administering the compliance offset program, these sections also include procedures for ARB to approve Offset Project Registries and Early Action Offset Programs. These new forms are designed to facilitate interested individuals and entities in becoming accredited or approved. To become an accredited offset verifier, the applicant must submit a completed Verifier Application to ARB along with the required documentation. To become an accredited offset verification body, an interested entity must submit a completed Verification Body Application to ARB along with the required documentation. To become an approved Offset Project Registry, an interested entity must submit a completed Offset Project Registry Application to ARB along with the required documentation. If the Registry applicant also wishes to become an approved Early Action Offset Program, it must make one additional attestation in Part IV of the Offset Project Registry Application. Once the verifier and Offset Project Registry applications have been reviewed by ARB and determined to have the potential to meet the minimum qualifications listed in the regulation, the verifier applicant or registry staff will be notified of the dates and locations of ARB approved training courses. Upon meeting the minimum qualifications listed in the regulation the Executive Officer may accredit the offset verifiers and offset verification body applicants and approve the Offset Project Registry and Early Action Offset Program applicants. For more information on the Compliance Offset Program, please visit this webpage: http://www.arb.ca.gov/cc/capandtrade/offsets/offsets.htm For any questions regarding the application forms, please contact Stephen Shelby in ARB’s Climate Change Program Evaluation Branch at (916) 327-8228. Information on submitting questions or comments will be provided during the webcast for remote participants. Staff’s presentation and all associated documents will be posted in advance of the workshop on ARB’s website at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation was adopted by the California Air Resources Board in October 2011, and formally went into effect January 1, 2012. The Cap-and-Trade Regulation, along with the Regulation for the Mandatory Reporting of Greenhouse Gas Emissions, has mechanisms to determine the compliance obligation for electricity generators and first jurisdictional delivers of electricity. These regulations define the responsible party for imports, identify appropriate uses for freely allocated allowances, identify the compliance obligation for allowable sources of imported electricity, and detail exemptions from a compliance obligation for certain electricity transactions. In Resolution 11-32, the Board directed ARB staff to work with stakeholders and other state agencies on several issues related to first jurisdictional deliverers of electricity. At this workshop, staff will discuss the definition of “electricity importer,” resource shuffling, qualified export requirements and calculation, and sales of electricity into the CAISO market. Panelists will discuss how California can most effectively invest these funds to support the goals of Assembly Bill 32 (AB 32) to reduce greenhouse gases, as well as encourage long-term transformation to improve public health and develop a clean energy economy. The public can share ideas about what criteria and programs should be prioritized in the development of an investment plan. ARB will soon be issuing a notice that provides additional detail about the meeting and how to participate. DATE: May 24, 2012 TIME: 1:30 p.m. – 5:00 p.m. PDT PLACE: California Environmental Protection Agency Building Byron Sher Auditorium, 2nd floor 1001 I Street Sacramento, California 95814 A live webcast of the meeting will be available at: http://www.calepa.ca.gov/broadcast/?BDO=1 The meeting notice will be available soon at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm. BACKGROUND: The Global Warming Solutions Act of 2006 (Chapter 488, Statutes of 2006 [AB 32, Núñez/Pavley]), requires California to reduce statewide greenhouse gas emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, ARB has developed a cap-and-trade program. The program establishes a statewide emissions limit on sources responsible for 85 percent of greenhouse gases and creates a financial incentive for investment in clean and efficient technologies. Under the program, a portion of allowances required for compliance will be auctioned. Strategic investment of auction funds can further the purposes of AB 32 and deliver long-term economic, environmental, and clean energy benefits. The first auction is scheduled for November 2012 and auctions will be held on a quarterly basis thereafter through 2020. DATE: Thursday, June 7, 2012 TIME: 9:00 am to 12:00 pm and 1:30 pm to 4:00 pm LOCATION: Banatao Auditorium, Sutardja Dai Hall University of California, Berkeley Berkeley, CA 94720 Directions to Sutdarja Dai Hall can be found at: http://ei.haas.berkeley.edu/pdf/Directions_Sutardja_Dai_Hall.pdf The Market Simulation Group (MSG) of the University of California Energy Institute, working with the California Air Resources Board, will hold a public meeting at the above time and location to gather input from stakeholders that will inform an assessment of design features of the California’s cap-and-trade market for greenhouse gas (GHG) emissions. The MSG is in the process of constructing an emission allowance market simulation model based on the market structure, current market rules and other fundamental aspects of the state’s GHG emission market. The model will be used to examine the potential for market power and other strategic behavior in the GHG emissions market. The objective of this meeting is to identify factors that can potentially detract from the efficient and competitive operation of the GHG emission market. There are three major topics for discussion: (1) aspects of the market design that could detract from market efficiency, (2) incentives market participants may have to not comply completely with the market rules, and (3) the effectiveness of mechanisms and process for monitoring market performance and compliance with the market rules. This meeting is meant to provide a forum for discussion between the MSG team and interested stakeholders about these topics. Stakeholders are asked to submit a brief, (no more than two pages) written summary of specific scenarios or design elements that may detract from market efficiency, create incentives for participants to fail to comply with market rules, or reduce the effectiveness of the market monitoring process. Written summaries should be submitted electronically to marketsimulationgroup@berkeley.edu no later than May 25, 2012. All submitted comments will be publicly posted on May 30. This webinar is geared toward smaller POUs that may not be familiar with the Cap-and-Trade Program. DATE: MAY 23, 2012 TIME: 10:00 AM – 12:00 PM REGISTER FOR THE WEBINAR AT: https://www1.gotomeeting.com/register/451618089 After registration you will be provided a link to view the webinar. The presentation will be posted before the webinar and a recording of the webinar will be available after the webinar at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation (Cap-and-Trade Regulation) and the revised Regulation for the Mandatory Reporting of Greenhouse Gas Emissions (Mandatory Reporting Regulation) were adopted by the California Air Resources Board in October 2011 and formally went into effect January 1, 2012. The Mandatory Reporting Regulation (MRR) requires first deliverers of electricity to report greenhouse gas emissions from electricity generation and imported electricity. Additionally, MRR requires all retail providers to report California retail sales. Under the Cap-and-Trade Regulation, first deliverers of electricity will have an obligation to surrender compliance instruments (allowances and offset credits) equal to their emissions (as reported under MRR) to ARB. Allowances will be freely provided by ARB to utilities. There are restrictions on the use of allowance value. These details will be covered in the webinar. Staff will also describe key dates and obligations that utilities must meet to comply with the regulations, as well as provide information about how utilities participate in the program. This presentation is targeted at smaller POUs that may not be familiar with the provisions of the Cap-and-Trade Program. California is working with WCI Partner jurisdictions and WCI, Inc. to develop systems to support the common goals of developing a regional program and the implementation of state and provincial GHG trading programs, including California’s cap-and-trade program. One of the systems being developed is the Compliance Instrument Tracking System Service (CITSS). The CITSS is the record of ownership of compliance instruments; records information related to accounts; enables and records compliance instrument transfers; facilitates compliance verification; and supports market oversight through the collection of relevant information. There are two primary components to the CITSS in the first release: user registration and account application. User registration is required in the CITSS prior to applying for entity compliance instrument accounts. Compliance instrument accounts must be established before an entity can apply to participate in the November GHG allowance auction. Today, July 9, 2012, the CITSS is being released for Cap-and-Trade User Registration and Compliance Instrument Account Application activities. The CITSS can be accessed at https://www.wci-citss.org For entities or individuals that intend to participate in the November 2012 auction: ARB recommends that (1) CITSS user registration for their account representatives be completed as quickly as possible, and no later than August 1, 2012; and (2) CITSS account application be completed no later than September 1, 2012. Following these deadlines will better ensure that necessary time is available for CITSS user registration and for account application approval required to participate in the November GHG allowance auction. To support California’s program implementation, the CITSS will be released in phases. User registration and account application functions are now available in Release 1. Additional CITSS functions such as allowance issuance and transfer are expected to be in Release 2 available in September of 2012. Training: Training materials supporting the use of the CITSS and more information on the webinars are available on the ARB website at http://www.arb.ca.gov/cc/capandtrade/markettrackingsystem/markettrackingsystem.htm Training webinars on CITSS User Registration and Account Applications will be held July 16th and 19th from 9:00 a.m. to 12:00 p.m. ARB Support: ARB has established a Help Desk to support the CITSS User Registration and Compliance Instrument Account Application. It can be reached at CACITSSHelpDesk@arb.ca.gov or by phone at (916) 324-7659. DATE: Monday, July 30, 2012 TIME: 10 am to 1 pm LOCATION: Cal/EPA Headquarters Building Sierra Hearing Room 1001 I Street Sacramento, California 95814 WEBCAST INFORMATION: This meeting will be webcast for those unable to attend in person. The webcast can be accessed on the day of the workshop at http://www.calepa.ca.gov/broadcast/. Information on submitting questions or comments will be provided during the webcast for remote participants. Staff’s presentation and all associated documents will be posted in advance of the workshop on ARB’s website at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation went into effect on January 1, 2012. The California Global Warming Solutions Act of 2006 (AB 32), which authorized the use of a market-based compliance mechanism such as a cap-and-trade program, required ARB to minimize emissions leakage to the extent feasible. AB 32 further defines emissions leakage as a reduction in emissions of greenhouse gases within the State that is offset by an increase in emissions of greenhouse gases outside the State. Leakage is possible when a business in California incurs regulatory costs not incurred by out-of-State businesses. In Resolution 11-32, the Board directed ARB staff to continue to review information concerning the emissions intensity, trade exposure, and in-State competition of industries in California, and to recommend to the Board changes to the leakage risk determinations and allowance allocation approach, if needed, prior to the allocation of allowances for the second compliance period. At this workshop, staff and researchers will discuss planned ARB-sponsored research efforts to establish baselines from which to measure leakage, along with models upon which to simulate potential leakage. One study will examine how changes in relative energy prices have historically impacted plant output, emissions, and employment. A second study will examine and document recent trends in trade flows in emissions-intensive, trade-exposed industries and estimate how trade flows have historically responded to changes in relative (domestic versus foreign) operating costs. Staff will also discuss a proposal to collect facility-level economic data from covered industrial entities necessary for the timely measurement and monitoring of potential emissions leakage related to the Cap-and-Trade Program. Staff will further discuss a possible proposal for increases in the percentages of the assistance factors generated from leakage risk calculations. Any potential changes to assistance factors will require regulatory amendments, and will therefore not be in place until 2013 at the earliest. At the October 2011 Board Meeting, and reflected in Resolution 11-32, the Board directed ARB staff to work with stakeholders to further develop the allowance allocation approach to the petroleum refining sector and associated activities for the second and third compliance periods. The evaluation is to include continuing analysis of the CWT approach, as well as treatment of hydrogen production, coke calcining, and other activities that may operate under a variety of ownership structures. DATE: Tuesday, August 28, 2012 TIME: 9:30 am to 3 pm LOCATION: Cal/EPA Headquarters Building Coastal Hearing Room 1001 I Street Sacramento, California 95814 WEBCAST INFORMATION: This meeting will be webcast for those unable to attend in person. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation went into effect on January 1, 2012. The Cap-and-Trade Regulation, along with the Regulation for the Mandatory Reporting of Greenhouse Gas Emissions, has mechanisms to determine the compliance obligations for the petroleum refining sector. The Cap-and-Trade Regulation also provides for distribution of allowances through a mix of direct allocation and auction in a system designed to reward early action and investment in energy efficiency and greenhouse gas emissions reductions. Allowances will be distributed to industry for the purposes of leakage prevention and transition assistance. Emissions intensity benchmarking is employed to determine allowances for allocation distribution for the refining sector. In Resolution 11-32, the Board directed ARB staff to work with stakeholders to further develop the allowance allocation approach to the petroleum refining sector and associated activities for the second and third compliance periods. The evaluation is to include continuing analysis of the Carbon Dioxide Weighted Tonne (CWT) approach, as well as treatment of hydrogen production, coke calcining, and other activities that may operate under a variety of ownership structures. At this technical workshop, staff will discuss preliminary findings on the CWT approach from ARB’s consultant, Ecofys, initiate stakeholder participation in the CWT analysis, and solicit stakeholder input for the next phase of the study. SPECIAL ACCOMMODATION REQUEST Special accommodation or language needs can be provided for any of the following: • An interpreter to be available at the hearing; • Documents made available in an alternate format or another language; • A disability-related reasonable accommodation. This draft work product will help facilitate discussion at Tuesday’s (August 28) technical workshop on the CWT. The report can be found by accessing this link: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm. The Air Resources Board (ARB or Board) staff will hold a technical workshop at the time noted below to discuss the Cap-and-Trade Program’s carbon dioxide weighted tonne (CWT) refinery benchmark that will be utilized starting in the second compliance period. The webcast can be accessed on the day of the workshop at http://www.calepa.ca.gov/broadcast/. Information on submitting questions or comments will be provided during the webcast for remote participants. Staff’s presentation and all associated documents will be posted in advance of the workshop on ARB’s website at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm. On July 9, 2012, the Compliance Instrument Tracking System Service (CITSS) was released for Cap-and-Trade User Registration and Compliance Instrument Account Application activities. The CITSS can be accessed at: https://www.wci-citss.org Many covered entities have not initiated the user registration and account application process. Entities that are required to consign allowances to the November Auction and covered industrial entities eligible for free allocation of allowances in November 2012 must have an account in the CITSS to consign or receive allowances. Additionally, entities and individuals that intend to participate in November 2012 auction must have an approved account in the CITSS prior to completing the separate Auction application which will be available from September 14th through October 15th. Establishing accounts in the CITSS is a multi-step process that can take several weeks to complete. To establish accounts, each entity must complete the following steps: 1. Two (2) representatives must complete the user registration online data entry in the CITSS. 2. Both representatives must complete and submit required hard copy documentation required for user registration. 3. Both representatives must receive user registration approval from the California Registrar. 4. The entity must complete account application data entry in the CITSS to establish an entity account. 5. The entity must complete and submit account application forms and hard copy documentation. 6. Receive approval of the account application from the California Registrar. Representatives of covered entities have two (2) options for submitting the user registration hard copy documentation. Guidance on the options that should be reviewed by the individuals and the entity is available at: http://www.arb.ca.gov/cc/capandtrade/markettrackingsystem/markettrackingsystem.htm In addition, all entities with direct corporate associations to other entities that have or will establish accounts in the CITSS must complete a Consolidated Entity Account form. The form must be submitted with the account application documentation (Step 5) no later than September 15th if the entity(ies) intend to participate in the November Auction. Guidance and the form are available at: http://www.arb.ca.gov/cc/capandtrade/markettrackingsystem/markettrackingsystem.htm The CITSS is the record of ownership of compliance instruments; records information related to accounts; enables and records compliance instrument transfers; facilitates compliance verification; and supports market oversight through the collection of relevant information. To support California’s program implementation, the CITSS is being released in phases. User registration and account application functions are now available in Release 1. Additional CITSS functions such as allowance issuance and transfer are expected to be in Release 2 available in October of 2012. Training: Training materials supporting the use of the CITSS and more information on the webinars are available on the ARB website at: http://www.arb.ca.gov/cc/capandtrade/markettrackingsystem/markettrackingsystem.htm ARB Support: ARB has established a Help Desk to support the CITSS User Registration and Compliance Instrument Account Application. The CITSS provides accounts for market participants to hold and retire compliance instruments and to participate in transactions of compliance instruments with other account holders. Expanded functionality of the CITSS is anticipated to be released the week of October 8, 2012. Training webinars on the expanded CITSS functions included in this release will be held October 16th from 1:00 p.m. to 4:00 p.m. and October 23rd from 9:00 a.m. to 12:00 p.m. The two webinars will present the same information. Details on the webinars and the link to register are available on the ARB website at the address above. The California Air Resources Board’s (ARB) California Cap-and-Trade Program became effective on January 1, 2012, with an enforceable compliance obligation beginning with calendar year 2013 Greenhouse Gas (GHG) emissions. California is working to develop systems to support the implementation of California’s Cap-and-Trade Program. One of the systems being developed is the CITSS which is the record of ownership of compliance instruments; records information related to accounts; enables and records compliance instrument transfers; facilitates compliance verification; and supports market oversight through the collection of relevant information. The CITSS was released for user registration and account application in July 2012. User registration is required in the CITSS prior to applying for entity compliance instrument accounts. Compliance instrument accounts must be established before an entity can apply to participate in the November GHG allowance auction. Expanded functionality of the CITSS anticipated to be released the week of October 8, 2012 includes assignment of additional account representatives and viewing agents, account management, and compliance instrument transfer activities. The CITSS can be accessed at https://www.wci-citss.org For entities with approved accounts, the expanded CITSS functions will allow approved account representatives to propose additional account representatives, however, these requests will not be approved prior to October 15th and will not be effective for the November Auction. The Compliance Instrument Tracking System Service (CITSS) is a market tracking system that supports the implementation of California’s Cap-and-Trade Program. The CITSS provides accounts for market participants to hold and retire compliance instruments and to participate in transactions of compliance instruments with other account holders. To ensure the successful implementation of the CITSS and California’s Cap-and-Trade Program, ARB staff are holding design webinars to discuss stakeholder proposals that would enhance or modify CITSS functionality. Interested stakeholders are encouraged to submit functionality change proposals to the ARB and to attend the design webinars. ARB requests that stakeholders submit design proposals or functionality requests to rlanguel@arb.ca.gov no later than January 4, 2013. A sample format for submitting design proposals is available at www.arb.ca.gov/citss/#webinars. The first webinar will be held to discuss stakeholder design proposals on January 16, 2013, from 10:00 a.m. to 12:00 p.m. PT. The webinar agenda and the link to register are available on the ARB website at www.arb.ca.gov/citss/#webinars. The California Cap-and-Trade Program became effective on January 1, 2012, with an enforceable compliance obligation beginning with calendar year 2013 Greenhouse Gas (GHG) emissions. The CITSS can be accessed at https://www.wci-citss.org. Training materials supporting the use of the CITSS and more information on the webinar are available on the ARB website at http://www.arb.ca.gov/citss. ARB has established a Help Desk to support stakeholder use of the CITSS, which can be reached by phone at 1-866-682-7561. The Cap-and-Trade Regulation allows covered entities to use a limited number of ARB offset credits to fulfill up to 8% of their compliance obligation. Offset credits are tradable compliance instruments that represent verified GHG emission reductions or removal enhancements made in sectors and sources not covered by the Cap-and-Trade Program.
