The Scoping Plan guides development and implementation of California’s groundbreaking greenhouse gas emission reduction programs. The Air Resources Board is required to update the Scoping Plan every five years. The 2013 Scoping Plan update lays out the remaining steps to the 2020 limits set by AB 32. It moves the process forward with an approach which cuts across economic sectors to combine greenhouse gas reductions with reductions of smog-causing pollutants. It also describes the need to extend key reduction programs now underway. The 2013 update lays the scientific and technological foundation to ensure sustainable midterm and long-term emission reductions as well as public health and economic goals. To achieve these goals California will need to continue building on the AB 32 framework over the coming decades. The update also lays out a set of new actions that will move the state farther along the path to a low-carbon, sustainable future. Some of the actions are near-term, while others are focused on longer-term efforts that will provide major benefits well into the future. Every major economic sector in the state must play an increasing role in this cross-cutting effort to reduce greenhouse gases and smog. Success will require the creation of new policies in some sectors, and expanding and refining existing policies in others. The update identifies eight key sectors for ongoing action: • Energy • Transportation, fuels, land use and infrastructure • Agriculture • Water • Waste management • Natural lands • Short-Lived Climate Pollutants (such as methane and black carbon) • Green Buildings The 2013 update incorporates the latest scientific consensus which indicates the need for accelerated emissions reductions in the coming decades to achieve climate stabilization. This update calls for a midterm statewide greenhouse gas reduction target, and specific reduction targets for each of the key sectors to guide California’s path toward an 80 percent reduction by 2050. MSG Final Report ARB has released the final report of the Market Simulation Group (MSG). MSG was an advisory group of academic economists established by the California Air Resources Board (ARB) in 2012 to use simulation methods to evaluate the market rules governing the California Greenhouse Gas Cap-and-Trade market. ARB established MSG through an interagency agreement with the University of California, Berkeley. A key element of the agreement, which ran through March 2014, was the requirement that MSG obtain input directly from stakeholders. MSG began its work with a public meeting with stakeholders at the campus of the University of California at Berkeley on June 7, 2012. MSG provided an overview on the potential sources of disruption in the California Cap-and-Trade market. MSG then invited stakeholders to identify specific concerns with the market rules or potential market scenarios that stakeholders thought created risks of market disruption. In addition, information on the estimated greenhouse gas, criteria pollutant, and toxics pollutant emission reductions and costs, as reported by the facilities, is included. The data presented in the reports are aggregated in a manner to be consistent with the public disclosure requirements under California Code of Regulations (CCR) §95610. The release of the EEA Public Reports is Phase 1 of a multi-phase program. More information on this multi-phase program is provided on the website above. The Oil & Gas/Minerals and Hydrogen Sector Public Reports, the next two of the five reports to be released, will be available at the website above at noon on Wednesday, July 30, 2014. BACKGROUND: AB 32, the California Global Warming Solutions Act of 2006 (Assembly Bill 32 (AB 32); Nunez, Chapter 488, Statutes of 2006) is a comprehensive, multi-year program to reduce greenhouse gas (GHG) emissions in California. ARB has adopted a Scoping Plan and, together with other State and local agencies, has developed and implemented numerous regulations and programs, including the Cap-and-Trade Program to reduce emissions to meet AB 32 goals. Any expenditure of State proceeds from the Cap-and-Trade auctions must comply with legislative requirements. State law directs CalEPA to identify disadvantaged communities for investment of Cap-and-Trade auction proceeds. Senate Bill (SB) 535 (De León, Chapter 830, Statute of 2012) requires that 25 percent of the proceeds be invested in projects that benefit disadvantaged communities and at least 10 percent be invested in projects located within those communities. State law also directs ARB to develop guidance for State agencies on approaches to maximize benefits to disadvantaged communities. CalEPA selected CalEnviroScreen as the tool to identify disadvantaged communities. In April 2014, the Office of Environmental Health Hazard Assessment released CalEnviroScreen Draft Version 2.0, http://oehha.ca.gov/ej/ces2.html, which ranks communities based on numerous indicators that reflect pollution burdens and population characteristics. BACKGROUND: AB 32, the California Global Warming Solutions Act of 2006 (Assembly Bill 32 (AB 32); Nunez, Chapter 488, Statutes of 2006) is a comprehensive, multi-year program to reduce greenhouse gas (GHG) emissions in California. ARB has adopted a Scoping Plan and, together with other State and local agencies, has developed and implemented numerous regulations and programs, including the Cap-and-Trade Program to reduce emissions to meet AB 32 goals. Any expenditure of State proceeds from the Cap-and-Trade auctions must comply with legislative requirements. State law directs CalEPA to identify disadvantaged communities for investment of Cap-and-Trade auction proceeds. Senate Bill (SB) 535 (De León, Chapter 830, Statute of 2012) requires that 25 percent of the proceeds be invested in projects that benefit disadvantaged communities and at least 10 percent be invested in projects located within those communities. State law also directs ARB to develop guidance for State agencies on approaches to maximize benefits to disadvantaged communities. CalEPA selected CalEnviroScreen as the tool to identify disadvantaged communities. Further, the attestation must be updated before each auction to reflect any change in the status of an investigation that has occurred since the most recent auction application attestation was submitted. An auction applicant may use the Auction Application Attestation Disclosure Form available from ARB’s webpage to submit the required attestation disclosure and updates to previously submitted attestations by completing the form and submitting an original to ARB at the address on the back of the form at least 30 days prior to an auction in which it intends to participate. On May 29, 2014, the California Air Resources Board (ARB) initiated an investigation of compliance offset credits issued for ozone depleting substance destruction events that took place at the Clean Harbors Incineration Facility in El Dorado, Arkansas (Facility) which may have been generated while the facility was not in compliance with provisions of its operating permit issued under the federal Resource Conservation and Recovery Act (RCRA). The Executive Officer has made a preliminary determination. The preliminary determination will be made publicly available at noon PT, October 8th, 2014, here: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm The following steps provide detail on the process towards the issuance of a final determination. 1. The posting of the preliminary determination begins a 10-day comment period that starts at noon PT, October 8, 2014 through 5 pm PT, October 17, 2014. During the 10-day comment period, ARB invites public comment on the preliminary determination. The 10-day comment period serves as an opportunity for the public to review and respond to the information considered by the Executive Officer in making a preliminary determination. Any additional materials received during this comment period will be evaluated and considered by the Executive Officer in making the final determination. This comment period is not required by the Cap-and-Trade Regulation, but ARB believes it is important for stakeholders to be aware of the information that was reviewed in support of the preliminary determination and to have an opportunity to provide additional relevant information prior to the Executive Officer making a final determination. 2. The conclusion of the 10-day comment period starts the regulatory 30-day period for the Executive Officer to make a final determination as to whether ARB will invalidate any compliance offset credits generated at the Facility. 3. After the 30-day period begins, the Executive Officer may issue the final determination at any time and does not need to wait for the 30-day period to conclude. 4. CITSS Version 5.0 (CITSS 5.0) provides new functionality on the pages used to transfer compliance instruments, including new types of transfers and revisions to required data. The new functionality supports recent amendments to California’s Cap-and-Trade Regulation that take effect January 1, 2015. Stakeholder training for CITSS 5.0 is anticipated to be scheduled in January 2015. Additional information regarding CITSS 5.0 will be available soon on the California Air Resources Board (ARB) CITSS webpage at http://www.arb.ca.gov/citss. Security Reminder: For security purposes, when using CITSS, please do not save your password using a web browser and clear the browser’s cache upon completion of each CITSS session. Annual Allocation Holding Account Reminder: This reminder applies to entities that have an Annual Allocation Holding Account (AAHA) in CITSS. On January 1, 2015, allowances now held in your AAHA (general or compliance) will be automatically transferred to your General Account or your Compliance Account, respectively. Please be aware that once this transfer has taken place, these allowances will count towards your holding limit, which in 2015 is 13,370,000. At the beginning of each calendar quarter, the California Air Resources Board (ARB) and Québec’s ministère du Développement durable, de l’Environnement et de la Lutte contre les changement climatiques (MDDELCC) publish an updated Compliance Instrument Report summarizing the number of compliance instruments held by entities in the linked California and Québec Cap-and-Trade Programs. This report is updated and published on the second business day of each calendar quarter, and is based on information pulled from the Compliance Instrument Tracking System Service (CITSS) as of noon (Pacific) and 3pm (Eastern) the business day prior to the posting date. With the linked programs, California and Québec must coordinate postings of public information, so posting of the Compliance Instrument Report will occur on the second business day of the calendar quarter taking into account both jurisdictions’ holiday schedules. For Québec, the second business day of January 2015 is January 6, 2015. As such, ARB and MDDELCC will pull data from CITSS on January 5, 2015, and post the updated Compliance Instrument Report on January 6, 2015.
