Therefore, the Air Resources Board (ARB) will not be holding the April 2015 Reserve Sale. The next Reserve Sale is scheduled for June 30, 2015. A Reserve Sale Notice will be posted approximately 30 days prior to the scheduled date. The number of APCR allowances potentially available and the tier prices in effect during 2015 are provided in the 2015 Annual Allowance Price Containment Reserve Notice available on the ARB Auction Information webpage at www.arb.ca.gov/auction. Please note that ARB will no longer be issuing list serve notices when a determination is made that a reserve sale will not be held. The EEA Public Reports provide a sector-wide and facility-specific summary of the energy efficiency improvement projects identified by all of the reporting facilities. In addition, information on the estimated greenhouse gas, criteria pollutant, and toxics pollutant emission reductions and costs, as reported by the facilities, is included. The data presented in the reports are aggregated in a manner to be consistent with the public disclosure requirements under California Code of Regulations (CCR) §95610. The release of the EEA Public Reports is Phase 1 of a multi-phase program. More information on this multi-phase program is provided on the website above. The Electricity Generation Sector Public Report, the fifth and final of the five reports to be released, will be available at the website above at noon on Friday, April 24, 2015. Short-lived climate pollutants (SLCPs) include methane, tropospheric ozone, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide (CO2). Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to further reduce SLCP emissions in California. The Concept Paper presents initial ideas that will be considered and evaluated in the coming months by ARB staff, in coordination with other agencies, as it develops a SLCP Strategy pursuant to SB 605. The concepts included in this discussion draft do not represent commitments at this time, nor do they comprise an exhaustive list of elements or considerations that may be included in the Strategy or shape its development. The intent of the paper is to elicit new ideas and refine strategies to reduce emissions of SLCPs throughout the state. The Concept Paper will be discussed at a May 27, 2015, public workshop. The comments received on the Concept Paper will inform the development of a draft Strategy that ARB expects to release for public comment later this summer. Accompanying the GHG inventory data is the “Trends of Emissions and Other Indicators” report, which explains trends in statewide GHG emissions from major sectors. The information will be summarized separately for investor-owned utilities (IOU) and all other utilities (publicly owned utilities and electrical co-operatives). The report will show total dollar amounts spent on different categories of uses by IOUs and non-IOUs, and describe all reported uses of the value of vintage 2013 allowances allocated to EDUs. IOU information will primarily be based on IOU public reports and forecasts as submitted to the California Public Utilities Commission. Non-IOU information will be based entirely on the vintage 2013 EDU use of allowance value reports submitted to ARB. The Summary of Vintage 2013 Electrical Distribution Utility Allocated Allowance Value Reports will not reveal information about participation in any specific auction. Individual utilities’ vintage 2013 EDU use of allowance value reports and any related attachments submitted by utilities to ARB will not be released, as these reports may reveal the entities’ allowance acquisition strategies. Background ARB allocates allowances to EDUs and natural gas suppliers on behalf of ratepayers. The regulation stipulates that EDUs and natural gas suppliers must use the value associated with these allowances for the benefit of retail ratepayers of each EDU or natural gas supplier, consistent with the goals of AB 32. Each EDU or supplier must report annually to ARB describing how it used the allowances allocated to it and how that use was consistent with the requirements of the Cap-and-Trade Regulation. Once approved, filed with the Secretary of State, and published in the California Code of Regulations, the modified Regulation and protocols will become effective. ARB has requested an early effective date for the Regulation and protocols of November 1, 2015; this request is subject to OAL approval. Once effective, rice projects will be eligible for listing under the new Rice Protocol and all new forest projects must list under the June 25, 2015, updated version of the Forest Protocol. Existing forest projects will be eligible to update to the June 25, 2015, version of the Forest Protocol as well. Background At its December 18, 2014, public hearing, the Board considered the Staff Report: Initial Statement of Reasons released on October 28, 2014, and adopted Resolution 14-44, which directed staff to consider the comments submitted during the rulemaking and make appropriate modifications. The Board directed the Executive Officer to make the modified regulatory language, and any additional conforming modifications, available for public comment, with any additional supporting documents and information, for a period of at least 15 days as required by Government Code section 11346.8. The Board further directed the Executive Officer to consider written comments submitted during the public review period and make any further modifications that are appropriate available for public comment for at least 15 days, and present the Regulation to the Board for further consideration. On May 20, 2015, after reviewing public comments and meeting with interested stakeholders, staff released a Notice of Public Availability of Modified Text and Availability of Additional Documents in response to Board direction at the December 2014 hearing and Resolution 14-44. At a public hearing held on June 25, 2015, the Board approved Resolution 15-19, approving the written responses to environmental comments, making required California Environmental Quality Act and other findings, and adopting the final regulatory amendments, including the Rice Cultivation Projects and U.S. Forest Projects Compliance Offset Protocols. The Resolution also directed the Executive Officer to finalize the Final Statement of Reasons (FSOR) for the regulatory amendments and to submit the final rulemaking package to the Office of Administrative Law for review. The FSOR provides written responses to all comments received on the proposed amendments during the 45-day and 15-day comment periods, during the December 18, 2014, Board hearing, and during the final June 25, 2015, Board hearing. The Scoping Plan was first approved by the Board in 2008 and, per AB 32, must be updated every five years to evaluate the mix of AB 32 policies to ensure that California is on track to achieve the 2020 GHG reduction goal. The 2013 First Update to the Climate Change Scoping Plan defined ARB’s climate change priorities for the next five years and laid the groundwork to start the transition to the post-2020 goals set forth in Executive Orders S-3-05 and B-16-2012. The 2013 Update also recommended the need for a 2030 mid-term target to establish a continuum of action to reduce emissions, not just for stated limits in 2020 or 2050, but also every year in between. The 40 percent below 1990 levels mid-term target set by Executive Order B-30-15 is critical to help frame the additional suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions. Short-lived climate pollutants (SLCPs) include methane, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide. Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to reduce SLCP emissions in California. The Draft Strategy describes ongoing and potential new measures to reduce SLCP emissions from major sources in the State, and describes current and future research needs for improving the SLCP emission inventory and better understanding potential mitigation measures. The Draft Strategy will be discussed at public workshops in October. Comments received on the Draft Strategy will inform the development of a Proposed Strategy, which will be will presented to the Board in late 2015. The October 28, 2015 workshop will commence the public process to evaluate potential next steps for considering the potential to include international, sector-based offset credits issued by subnational programs designed to reduce emissions from tropical deforestation and forest degradation within the Cap-and-Trade Regulation. In preparation of the October 28, 2015 workshop, ARB staff will release a white paper describing the importance of the tropical forestry sector for addressing climate change, the history of California’s engagement on this topic, including with the Governors’ Climate and Forests Task Force (GCF), the relevance to California, and possible steps needed to develop potential regulatory amendments related to tropical forest sector-based crediting programs. The white paper will also include an initial analysis of a set of recommendations provided to ARB by the REDD Offset Working Group in 2013. The Board has subsequently approved limited amendments to the Regulation in June 2012, October 2013, April 2014, September 2014, and most recently June 2015. The upcoming 2016 amendments will seek to improve Program efficiency and chart post-2020 implementation of the Program. California first recognized the importance of addressing emissions from the deforestation and degradation of tropical forests in the 2008 AB 32 Scoping Plan. California further recognized this importance through the inclusion of general placeholder provisions within the Cap-and-Trade Regulation adopted in 2011 and later in the first update to the AB 32 Scoping Plan in 2014. ARB staff has continued to evaluate these types of programs, including through California’s membership in the Governors’ Climate and Forests Task Force, a coalition of 29 subnational jurisdictions seeking to advance jurisdictional programs designed to promote low emissions development and reduced emissions from deforestation and land use, and to link these activities with greenhouse gas compliance programs and other pay-for-performance opportunities. The Investment Plan does not propose any specific funding levels or percentage allocations–those decisions are made by the Legislature in the State Budget process. The Draft Second Investment Plan is now available and will be discussed during three public workshops. In each location, representatives from the Department of Finance, the Air Resources Board, and other State agencies will provide an overview of current investments, introduce the draft recommendations presented in the document, and respond to questions to aid stakeholders in developing written comments on potential future investments. Staff will present policy options and modeling results and seek stakeholder input regarding California’s potential strategy for Clean Power Plan compliance. The staff presentation will include initial approaches and results for electricity sector carbon emissions analysis consistent with the Clean Power Plan, and options for continued analysis, as well as initial discussion for how California’s compliance plan may interact with regional electricity and carbon markets. Staff will also discuss potential modifications to the Cap and Trade and Mandatory Greenhouse Gas Reporting Regulations, including modifications which may be effective in the post-2020 Program, and to permitting programs, which may be proposed in 2016 to enable Clean Power Plan compliance. Staff anticipates that the Cap-and-Trade Regulation will play a large role in the Clean Power Plan compliance plan. These amendments may include changes to reporting and verification deadlines, compliance periods, changes needed to address federal plan “backstop” requirements, and treatment of imported electricity. These estimates are for State-owned allowances only and do not include estimates of allowances consigned for sale by utilities from their electricity or natural gas allocation. Background Under the Cap-and-Trade Program, emissions caps and associated greenhouse gas (GHG) allowance budgets are calculated for each calendar year. In the Cap-and-Trade Program, the calendar year from which the allowances are assigned is referred to as the “budget year.” California GHG allowances are sold at one of four quarterly auctions held by ARB each year in February, May, August, and November. The first report provides a detailed summary of covered entity compliance status for the first compliance period (2013-2014) of the California Cap-and-Trade Program. The second report is the Summary of Transfers Registered in CITSS by California and Québec Entities in 2014, which provides details on the number of completed transfers, the quantity of compliance instruments transferred between market participants, and the weighted average prices of the transfers. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation (Regulation) was adopted by the California Air Resources Board in October of 2011, and formally went into effect January 1, 2012. Entities subject to the Regulation have a compliance obligation for their greenhouse gas emissions beginning on January 1, 2013. The Regulation was amended in early 2013 to link the California and Québec programs beginning January 1, 2014. The first compliance period status report will contain a detailed list of covered entities and a tabulation of the compliance instruments they submitted to meet their obligations for the first compliance period. On November 4, 2014, covered entities were required to surrender compliance instruments to cover 30% of their 2013 emissions. ARB published a report for 2013 compliance at: http://www.arb.ca.gov/cc/capandtrade/2013compliancereport.xlsx. On November 2, 2015, covered entities were required to surrender compliance instruments to cover the remaining 70% of their 2013 emissions, and 100% of their 2014 emissions. For this compliance surrender, both vintage 2013 and 2014 allowances were eligible for compliance use. Covered entities also may have used offset credits up to the quantitative usage limit specified in section 95854 of the Regulation (up to eight percent). Future vintage year allowances generally could not be used to satisfy the first compliance period obligation, with the limited exception of certain entities who have received 2015 and 2016 true-up allowances as described in section 95894 of the Regulation. The second data report tabulates the transfers of compliance instruments made through the Compliance Instrument Tracking System Service (CITSS) in 2014. For transfers of allowances, the table provides a breakdown by vintage and whether the transfer was priced or unpriced. Most transactions between independent market participants, such as bilateral transactions or transactions cleared on the Intercontinental Exchange (ICE), are conducted at a price that is entered into the transfer request in CITSS. However, there are numerous transactions made without an explicit price. These include, for example, transfers between corporate associates, between an electric distribution utility and a generator as part of a power purchase agreement, between publicly-owned utilities, or as part of an agreement that transfers compliance instruments with other products. The table contains a separate accounting of transfers of offsets, again with a breakdown between priced and unpriced transfers. Offsets transfers are further broken down by project type. All state agencies with jurisdiction over sources of GHG emissions were directed to implement measures to achieve reductions of GHG emissions to meet the 2030 and 2050 targets. ARB was directed to update the AB 32 Scoping Plan to reflect the 2030 target, and therefore, is moving forward with the update process. Presentations will include a high-level overview of the modeling tools that will be used to evaluate the economic impact of policies that may be proposed to help achieve the 2030 target. Presentations will also include an outline of the California PATHWAYS model, including model inputs and outputs, and a preliminary list of policies to be considered in the Reference Scenario. The workshop will also include an introduction to the economic reviewers for the 2030 Target Scoping Plan Update. The discussion will include information on the role, tasks, and timeline for the economic reviewers. The economic reviewers may provide initial thoughts on the tools and methods proposed for the economic modeling and evaluation for the 2030 Target Scoping Plan Update. Staff will also discuss potential updates to the State’s GHG inventory methodology. Background Scoping Plan In 2006, the Legislature passed the California Global Warming Solutions Act of 2006 (Assembly Bill 32 [AB 32]; Stats. 2006, chapter 488). AB 32 created a comprehensive, multi-year program to reduce GHG emissions in California. AB 32 required ARB to develop and approve a Scoping Plan that describes the approach the State will take to reduce GHGs to achieve the goal of reducing emissions to 1990 levels by 2020. The Scoping Plan was first approved by the Board in 2008 and, per AB 32, must be updated every five years to evaluate the mix of AB 32 policies to ensure that California is on track to achieve the 2020 GHG reduction goal. The 2013 First Update to the Climate Change Scoping Plan defined ARB’s climate change priorities for the next five years and laid the groundwork to start the transition to the post-2020 goals set forth in Executive Orders S-3-05 and B-16-2012. The 2013 Update also recommended the need for a 2030 mid-term target to establish a continuum of action to reduce emissions, not just for stated limits in 2020 or 2050, but also in between. The 40 percent below 1990 levels mid-term target set by Executive Order B-30-15 is critical to help frame the additional suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions.
