Identified parties have provided information to ARB, and the Executive Officer has requested and received additional information to make a final determination. This notice begins the regulatory 30-day period for the Executive Officer to make a final determination as to whether ARB will invalidate any compliance offset credits generated at the Facility. After the 30-day period begins, the Executive Officer may issue the final determination at any time and does not need to wait for the 30-day period to conclude. The release of the final determination will be noticed ahead of time to ensure all market participants receive the information simultaneously. Once the final determination is made publicly available, offsets determined to be valid that were not allowed to be transferred during the investigation will no longer be blocked from being transferred. Under the pilot program, ARB will fund a regulatory verification and an alternative methods verification for participating projects’ first two reporting periods. The objective of the pilot program is to compare the rigor of alternative verification methods to existing regulatory verification requirements to determine if alternative, less comprehensive verification methods may be incorporated into a future version of the Compliance Offset Protocol Rice Cultivation Projects. Under the pilot program, ARB will contract directly with accredited offset verification bodies to perform the required regulatory verification and the alternative verification for the first two reporting periods of participating projects. The regulatory verification and alternative verification will be conducted by different verification bodies. The alternative verification will be conducted solely for the purpose of evaluating alternative verification methods and cannot be used for the issuance of ARB offset credits. ARB regularly audits verifications as part of implementing its Compliance Offset Program. ARB will audit all of the verifications performed under pilot program. As with any verification audit, participants in the pilot program must make themselves available to ARB staff conducting the audit. Covered product data are used to calculate annual allowance allocations to oil and gas producers under the Cap-and-Trade Regulation. To date, ARB has received no input on the contents of the white paper. The Cap-and-Trade Regulation allows ARB to investigate and invalidate any issued compliance offset credits that were generated if the offset project activity and implementation of the offset project was not in accordance with all local, state, or national environmental and health and safety regulations during the reporting period for which the ARB offset credit was issued. During the period of review and until a final determination is issued, ARB has blocked transfers of potentially impacted compliance offset credits. Once ARB blocked the transfer of compliance offset credits under investigation on September 29, 2015, all parties identified as holders of potentially impacted compliance offset credits had 25 calendar days to provide additional information to ARB to aid in the review. BACKGROUND Mandatory Greenhouse Gas Emissions Reporting Regulation The California Air Resources Board (ARB) first approved the MRR in 2007, with revisions in 2010, 2012, 2013, and 2014. All state agencies with jurisdiction over sources of GHG emissions were directed to implement measures to achieve reductions of GHG emissions to meet the 2030 and 2050 targets. ARB was directed to update the AB 32 Scoping Plan to reflect the 2030 target, and therefore, is moving forward with the update process. The mid-term target is critical to help frame the suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions. In an effort to further the vision of AB 32, Governor Brown identified key climate change strategy pillars in his January 2015 inaugural address. The pillars recognize that several major areas of the California economy will need to reduce emissions to meet the 2030 greenhouse gas emissions target. One of the key pillars identified by Governor Brown was to ensure that State agencies are managing farm and rangelands, forests and wetlands so they can store carbon. Environmental Analysis This workshop will serve as a scoping meeting as required by the California Environmental Quality Act (CEQA). Pursuant to CEQA and ARB’s Certified Regulatory Program (Cal. Code Regs., tit. 14, §15251(d); Cal. Code Regs., tit. 17, §§ 60000–60008), staff is reviewing the Proposed 2030 Target Scoping Plan Update to determine if the proposed project will result in any potentially significant adverse environmental impacts. Staff will provide an overview of ARB’s process for preparing the environmental analysis (EA) and its content. Staff welcomes public input at the workshop on the appropriate scope and content of the EA at the beginning of our process, including the reasonably foreseeable methods of compliance with the Proposed 2030 Target Scoping Plan Update, the potential significant adverse impacts associated with the methods of compliance, potential feasible mitigation measures, and feasible alternatives to the proposal that could reduce or eliminate any significant adverse impacts. Background on the 2030 Target Scoping Plan Update This public workshop is part of the public process to update the AB 32 Scoping Plan to reflect the Governor’s Executive Order B-30-15, which establishes a mid-term GHG reduction target for California of 40 percent below 1990 levels by 2030. All state agencies with jurisdiction over sources of GHG emissions were directed to implement measures to achieve reductions of GHG emissions to meet the 2030 and 2050 targets. ARB was directed to update the AB 32 Scoping Plan to reflect the 2030 target, and therefore, is moving forward with the update process. The mid-term target is critical to help frame the suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions. In an effort to further the vision of AB 32, Governor Brown identified key climate change strategy pillars in his January 2015 inaugural address. The pillars recognize that several major areas of the California economy will need to reduce emissions to meet the 2030 greenhouse gas emissions target. One of the key pillars identified by Governor Brown was to ensure that State agencies are managing farm and rangelands, forests and wetlands so they can store carbon. The potential revisions would also support California’s plan for compliance with the U.S. Environmental Protection Agency’s (U.S. EPA) Clean Power Plan. ARB staff had initially proposed a schedule for these amendments wherein staff reports and draft regulation orders would be released for a formal, 45-day public comment period at the end of May 2016 prior to the Board’s initial consideration of the amendments at the July 2016 Board hearing and a final Board hearing in Spring 2017. ARB staff is now proposing the following updated schedule for amendments to the Cap-and-Trade Program and MRR: July 2016 - Release of staff reports and draft regulation orders and beginning of formal public comment period September 2016 – Initial Board Hearing Spring 2017 – Final Board Hearing October 2017 – Adopted Regulations become effective Background Mandatory Greenhouse Gas Emissions Reporting Regulation ARB first approved the MRR in 2007, with revisions in 2010, 2012, 2013, and 2014. Their relative potency in terms of how they heat the atmosphere can be tens to thousands of times greater than CO2. SLCPs include black carbon, methane, and fluorinated gases, including hydrofluorocarbons. The impacts of SLCPs are especially strong within the near term. Reducing these emissions can have an immediate beneficial impact on climate change. SLCP reductions are important to continuing and maintaining the greenhouse gas reductions called for by AB 32 (Nunez, Chapter 488, Statutes of 2006) and SB 605 (Lara, Chapter 523, Statutes of 2014), and to ensuring emissions meet the statewide greenhouse gas emission limit that AB 32 established. The Proposed Strategy is identified in the First Update to the Climate Change Scoping Plan as one of the recommended actions to achieve additional greenhouse gas emission reductions. SB 605 further requires ARB, in coordination with other State agencies and local air districts, to develop a strategy to further reduce SLCP emissions in California. A Draft Strategy was released for public comment on September 30, 2015. After considering comments received, ARB staff released the Proposed Strategy on April 11, 2016, which will be presented to the Board at a public meeting on May 19, 2016. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. Their relative potency in terms of how they heat the atmosphere can be tens to thousands of times greater than CO2. SLCPs include black carbon, methane, and fluorinated gases, including hydrofluorocarbons. The impacts of SLCPs are especially strong within the near term. Reducing these emissions can have an immediate beneficial impact on climate change. SLCP reductions are important to continuing and maintaining the greenhouse gas reductions called for by AB 32 (Nunez, Chapter 488, Statutes of 2006) and SB 605 (Lara, Chapter 523, Statutes of 2014), and to ensuring emissions meet the statewide greenhouse gas emission limit that AB 32 established. The Proposed Strategy is identified in the First Update to the Climate Change Scoping Plan as one of the recommended actions to achieve additional greenhouse gas emission reductions. SB 605 further requires ARB, in coordination with other State agencies and local air districts, to develop a strategy to further reduce SLCP emissions in California. A Draft Strategy was released for public comment on September 30, 2015. After considering comments received, ARB staff released the Proposed Strategy on April 11, 2016, which will be presented to the Board at a public meeting on May 19, 2016. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. ARB, California Energy Commission (CEC), and California Public Utilities Commission (CPUC) staff have continued to update Clean Power Plan reliability and modeling results. Staff have produced revised production cost modeling results to forecast electricity sector emissions under mid-range and stressful demand conditions through to 2031, and generated planning reserve margin estimates under these scenarios. This updated information includes an anticipated emissions level from the sector relative to federal targets. Offsets are a key element of the flexibility afforded by a Cap-and-Trade Program to help ensure that the needed GHG emissions reductions are cost-effective. Offsets offer low- cost emissions-reduction opportunities for covered entities to meet up to 8% of their compliance obligation. Offsets are tradable credits that represent verified GHG emissions reductions made in areas or sectors not covered by the Cap-and-Trade Program. One offset credit is equal to one metric ton carbon dioxide equivalent of GHG emission reductions. These amendments will be first considered at a Board hearing in September 2016 and voted on at a second Board hearing in Spring 2017. Staff's proposal will include amendments for the following main topics: -Establish new emissions caps beyond 2020 and continue all other provisions needed to implement the Program after 2020; -Establish new linkages; -Revise the requirements for unsold allowances and vintages available in the Current Auction; -Prevent emissions leakage in the most cost-effective manner through appropriate allowance allocation; -Continue the allocation of allowances to the utilities on behalf of rate-payers; -Provide for California compliance with the federal Clean Power Plan; and -Simplify participation in the Program by streamlining registration, auction participation, information management, and issuance of offset credits. To commence the formal rulemaking process pursuant to the Administrative Procedure Act, ARB will provide a draft of the formal regulatory package, including the Staff Report: Initial Statement of Reasons (ISOR), and the Proposed Regulation Order, to the Office of Administrative Law (OAL) on July 12, 2016. CO2 EOR Technical Discussion Carbon dioxide enhanced oil recovery (CO2 EOR) is a tertiary method of oil production that injects compressed CO2 into oil reservoirs and recovers additional crude oil beyond what is possible from the primary and secondary methods of crude production. In doing so, CO2 EOR projects can store CO2 in oil reservoirs. The use of oil reservoirs for geological sequestration may be attractive as these reservoirs were known to have good seals that retained oil and gas for million years prior to initial oil production. However, these seals may have been compromised during oil extraction and may introduce potential for CO2 leakage. The main goal of this technical discussion is to understand and receive recommendations on how to deal with the risks and particulars of permanent CO2 storage in oil fields using CO2 EOR. As such, we are looking to determine what considerations need to be taken into account to ensure that the CCS QM provisions for CO2 EOR as a storage method are robust and defensible, reservoir mechanical integrity is maintained throughout the lifetime of CO2 EOR projects, and CO2 leaks are minimized. The technical discussion also seeks inputs on co-optimization of oil production and CO2 storage. BACKGROUND The Board first formally adopted the Cap-and-Trade Regulation in October 2011, and subsequently approved limited amendments to the Cap-and-Trade Regulation in June 2012, October 2013, April 2014, September 2014, and most recently June 2015. Offsets are a key element of the flexibility afforded by a Cap-and-Trade Program to help ensure that the needed GHG emissions reductions are cost-effective. Offsets offer low- cost emissions-reduction opportunities for covered entities to meet up to 8% of their compliance obligation. Offsets are tradable credits that represent verified GHG emissions reductions made in areas or sectors not covered by the Cap-and-Trade Program. One offset credit is equal to one metric ton carbon dioxide equivalent of GHG emission reductions. In addition to providing compliance flexibility, the inclusion of offsets in the program will support the development of innovative projects and technologies from sources outside capped sectors that can play a key role in reducing emissions both inside and outside California. Offsets must meet rigorous criteria that demonstrate that the emissions reductions are real, permanent, verifiable, enforceable, and quantifiable. To be credited as an offset, the action or project must also be in addition to what is required by law or regulation or would otherwise have occurred under a conservative business-as-usual scenario. The release contains a data table providing details on the number of completed transfers, the quantity of compliance instruments transferred between market participants, and the weighted average prices of the transfers. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation (Regulation) was adopted by the California Air Resources Board in October of 2011, and formally went into effect January 1, 2012. Entities subject to the Regulation have a compliance obligation for their greenhouse gas emissions beginning on January 1, 2013. The Regulation was amended in early 2013 to link the California and Québec programs beginning January 1, 2014. The Summary of Transfers table is a joint release between California and Québec. For transfers of allowances, the table provides a breakdown by vintage and whether the transfer was priced or unpriced. Most transactions between independent market participants are conducted at a price that is entered into the transfer request in the Compliance Instrument Tracking System Service (CITSS). These include bilateral transactions and transactions cleared on spot or futures market exchanges. There are also numerous transactions made without an explicit price. These include, for example, transfers between corporate associates, between an electric distribution utility and a generator as part of a power purchase agreement, between publicly-owned utilities, or as part of an agreement that transfers compliance instruments with other products or services. The table contains a separate accounting of transfers of offsets, again with a breakdown between priced and unpriced transfers. Offsets transfers are further broken down by project type. For a list of simple ways you can reduce demand and cut your energy costs, visit the Flex Alert website at www.flexalert.org . ====================================================================== Date: Fri, 30 Dec 2016 12:31:51 -0800 Subject: arbcombo -- Integrated Emissions Visualization Tool From: lquattro@arb.ca.gov Assembly Bill (Garcia; AB 197) requires that the California Air Resources Board (ARB) make available on its web site the emissions of greenhouse gases, criteria pollutants, and toxic air contaminants throughout the state broken down to a local and subcounty level for stationary sources and to at least a county level for mobile sources. The data are to be displayed graphically and updated at least once a year. As a first step, ARB has posted the criteria and greenhouse gas emissions from large stationary sources that are subject to the Regulation for the Mandatory Reporting of Greenhouse Gas Emissions (MRR). Toxics data for MRR facilities will follow by January 1, 2018, as required by AB 197. The data covers the years 2008-2014. These data are already publically available on ARB’s web site, but will now be available via the Integrated Emissions Visualization Tool (IEVT), https://www.arb.ca.gov/ei/ei.htm The IEVT provides a simple to use interactive platform where users can select facilities by name, location, or industrial sector and view their reported emissions using maps, charts, and tabular format. The IEVT is an expanded version of the tool already available to display greenhouse gas emissions. This is an initial version of the IEVT, and ARB is looking for feedback from the public and others users.
