We are currently preparing guidance for equipment owner/operators with low-use equipment that would otherwise need to be bought into compliance and reported by January 31, 2011. The materials can be downloaded from the CHE website at the following link: http://www.arb.ca.gov/ports/cargo/cheamd2011.htm The amendments to CHE Regulation provide additional flexibility to owners/operators in an effort to reduce compliance costs, maintain the anticipated emissions reduction benefits of the regulation, and clarify several provisions in the regulation. The amendments address several areas including: retrofit requirements, operational requirements, emission standards, compliance requirements, definitions, and other clarifying language. Cargo handling equipment is used to transfer goods or perform maintenance and repair activities and includes equipment such as yard trucks (hostlers), rubber-tired gantry cranes, top handlers, side handlers, forklifts, and loaders. The Regulation for Mobile Cargo Handling Equipment at Ports and Intermodal Rail Yards was adopted in December 2005 to reduce diesel particulate matter in communities located near ports and intermodal rail yards. Attention: Owners/Operators Using or Planning to Use the “No VDECS Available” Extension (Section 2479 (f)(2)) or, Using or Planning to Use the Proposed “Low-Use Equipment” Extension (Proposed Section 2479 (f)(6)). Staff will be proposing for the Board’s consideration at the September 22, 2011, Air Resources Board hearing, additional conditions for the third and fourth years of a “No VDECS Available” compliance extension, and for the proposed “Low-Use Equipment” compliance extension, as described below. Application requirements for the proposed third and fourth years of the “No VDECS Available” compliance extension, in addition to those specified in the current regulatory language (Section 2479 (f)(2)), are being proposed to include the following: • Equipment owners or operators would agree to replace the equipment for which a third or fourth year of “No VDECS Available” compliance extension was granted with either electric or hybrid equipment, if available, at the end of the extension period. • Equipment, for which the basic reason a VDECS is not available is high engine exhaust opacity, would not be eligible for a third or fourth year of “No VDECS Available” compliance extension. Staff will also be proposing that the application requirements for the proposed low-use equipment compliance extension, in addition to those described in the proposed regulatory language, include the requirement that all applicable engines in a fleet for which a compliance option is feasible be brought into compliance. Additionally, staff will be proposing to modify the current Alternative Compliance Plan option in the regulation to include yard trucks. The public will have an opportunity to comment on these proposed modifications both in-person, at a September 22, 2011, Air Resources Board hearing, and in writing, during a new public comment period after the Board hearing. Please note that fleets which must report have until January 31, 2012 to complete their reporting. Please refer to the Truck and Bus Regulation User Guide at http://www.arb.ca.gov/msprog/onrdiesel/documents/tbuserguide.pdf for more information on how to report. There is no cost to report. Please be aware that the reporting requirements for fleets differ by gross vehicle weight rating (GVWR). Specifically: HEAVIER VEHICLES (GVWR more than 26,000 lbs) - No reporting is required for diesel truck owners that comply with the engine model year schedule and do not plan to use credits, and extensions. A fact sheet with the compliance requirements summary is available at http://www.arb.ca.gov/msprog/onrdiesel/documents/FSRegSum.pdf - Fleets that report by January 31, 2012 will have more flexibility to bring heavier vehicles into compliance. - Small fleets with three or fewer diesel vehicles must report all heavier trucks now if any have 1996 to 1999 model year engines of if you are an owner operator with a heavier low-mileage construction truck. Otherwise, you may wait until next year to report. LIGHTER VEHICLES (14,001 to 26,000 lbs) - No reporting is required, as clean-up requirements do not begin until January 1, 2015. Note that publicly and privately owned school buses have different clean-up requirements than other vehicles and do not need to be reported. Background On December 11, 2008, the Board approved for adoption the Truck and Bus regulation to control emissions from nearly all existing diesel powered heavy-duty trucks and buses operating in California. The regulation became effective under California law on January 8, 2010. The regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB regulations. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. On December 17, 2010, the staff recommended amendments, which are presently pending adoption, that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extend the time before a vehicle equipped with a PM filter would have to have an engine that meets 2010 model year emission standards. The amendments also defer engine replacements for vehicles without PM filters for two years until January 1, 2015. Prior to 2020, replacements are limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles will need to be equipped with an engine meeting 2010 model year emission standards.
