Date: Tue, 8 Jan 2013 15:09:07 -0800 Subject: cargo -- Cargo-Handling Regulation - Amendments From: zwang@arb.ca.gov AMENDMENTS APPROVED FOR REGULATION OF CARGO-HANDLING EQUIPMENT AT PORTS AND INTERMODAL-RAIL YARDS . The Office of Administrative Law has approved the Air Resources Board’s 2011 amendments to the 2005 Cargo Handling Equipment (CHE) Regulation. These amendments became effective October 14, 2012. This email offers a brief explanation of the amendments and provides additional information on implementation. The final regulatory language describing the amendments can be accessed here: http://www.arb.ca.gov/regact/2011/cargo11/finalfro.pdf. Low Use Extension This option (section (f)(6)) provides a two-year extension from the original compliance date for equipment operating less than 200 hours per year. A full two-year extension is not available for equipment with compliance dates that have already passed. For example, low-use equipment with an original compliance date of December 31, 2011, could be granted a low-use compliance extension, but only until December 31, 2013. CHE owners/operators interested in a low-use extension must submit an application to ARB staff. Transfers of Non-yard Truck Equipment This provision (section (c)(3)) allows the transfer of non-yard truck equipment between two ports or intermodal railyards under the same control or ownership. The equipment transfer cannot be used to meet compliance requirements. Prior to transferring CHE from one facility to another under the same ownership, owners/operators must apply to, and receive approval from, ARB - per section (k) of the amended regulation. Opacity Monitoring Another amendment (sections (e)(2)(A)5. and (e)(3)(A)3.) requires opacity monitoring for all equipment subject to the CHE regulation with the exception of equipment less than four years old. To enforce the opacity-monitoring requirements, ARB will request authorization from U.S. EPA and will not enforce until granted authorization. However, it is prudent for CHE owner/operators to prepare for this event by either having staff certified to conduct monitoring or prepare to obtain these services through service contracts. For more information regarding this advisory or technical questions concerning the regulation, please visit our web site at http://www.arb.ca.gov/cargo or contact Ms. Michele Houghton at 916.327.5638, or via e-mail at mhoughto@arb.ca.gov. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. Please forward this email to TRU genset owners (e.g. ocean carriers, lessors, etc.) and operators (e.g. port terminal operators; port depot operators, lessees, etc.); equipment managers; and/or people responsible for compliance with diesel engine emissions regulations, equipment registration, and/or reporting. TRU gensets are generator sets that are designed and used to provide electric power to electrically driven refrigeration units of any kind, such as refrigerated shipping containers. This Q&A answers questions ARB received from port operations stakeholders, such as: “Who gets a citation if a noncompliant TRU genset is dispatched at a port terminal or depot?” The short answer is: “The owner.” More detailed answers are provided in this Q&A for typical cases of genset ownership. This Q&A also discusses who is responsible for terminal Operator Reports for gensets used at ports. Operator Reports are required under the TRU Regulation. Port terminals and off-site depots are responsible for Operator Reports, but ARB may allow them to forego these reports if the port terminal or depot implements procedures to make sure all of the ocean carriers that own TRU gensets that are garaged, maintained, re-fueled, checked-out, and dispatched from the terminal or depot are submitting Operator Reports. A terminal is any place where a TRU or TRU gen set equipped truck, trailer, shipping container, railcar or TRU gen set is garaged, maintained, operated, or dispatched from, including a port terminal, port depot, dispatch office, or cross-dock facility. ARB’s Q&A for TRU Gensets is available at: http://www.arb.ca.gov/diesel/tru/documents/q&a_tru_gensets.pdf Where can I get more information? For general information about the TRU Regulation, the TRU Website is at: http://www.arb.ca.gov/diesel/tru/tru.htm The ARBER Registration Website is at: http://www.arb.ca.gov/arber/arber.htm ARBER Registration Help pages are at: http://www.arb.ca.gov/arber/trureg/trureg.htm ARBER Operator Report Help page is at: http://www.arb.ca.gov/arber/trureg/operator.htm TRU Advisories are listed at: http://www.arb.ca.gov/diesel/tru/advisories.htm If you have questions about compliance or registration in ARBER, please call the TRU Help Line at 1-888-878-2826 or call 1-916-327-8737. Background: TRUs are refrigeration systems powered by integral diesel internal combustion engines designed to control the environment of temperature-sensitive products that are transported in trucks, trailers, shipping containers, and railcars. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, and hydrocarbons, that all pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, and residential neighborhoods. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU gen set engines. Amendments were adopted by the Board in November 2010 and October 2011. ====================================================================== You are subscribed to the cargo mailing list.
